toexjJlainhowtheprominentroleoftheSATinselectivecollegeadmissions,dictatedinlargemeasurebyitsimportanceincollege-rankingandfinancialbond-ratingsystems,createsanincentiveforuniversitiestoadopt"minority-deficiency"over"test-deficiency"explanationsforracialdif-ferencesinSATscores.,TheArticlethenendeavorstoshiftthefocusfromthestatelawanti-"preference"constraintsplacedonpublicuniversitiestothefed-eralantidiscriminationconstraintsthatTitleVIimposesonthesameinstitu-tions.Itconsiderswhetheruniversitiesthatcompletelyabolishaffirmativeac-tiontocomplywithstateanti-affirmativeactioninitiativesmayactuallybebreakingthelawwithrespecttoTitleVI.Todernonstratethisj70int,thisArticleusesstatisticaltestsforidentifyingTitleVIdisparateimpact-"effectdiscrimi-nation"-toanalyzeselectiveCaliforniaandWashingtonpublicuniversityadmissionscyclesaftertheenactmentofanti-affirmativeactionlaws.Itfindsracialdisparitiesinadmissionstoaffirmativeaction-lessuniversitiesofsuffi-cientmagnitudethat,ifunjustified,couldestablishthataninstitutionhasacompellinginterestinconsideringracetocomplywithfederalantidiscrimina-tionlaw.Animportantconclusionjlowsfromthisanalysis.Stateanti-affirmativeactionlawsmaypermittheconsiderationofraceifundertakentoremedyfederal"racialeffectdiscrimination."
