theLegislature,forthematter,fromdealingwiththe
Seneca-Cayuga
Tribe.
The
firstparagraph
of
the
MOV
states"nothinghereinshallbebindinguponeitherparty,unlessanduntilthe
same
isformallyratifiedaccordingtoproceduresimplementedbyeachpartyfor

so."
Moreover,theparagraphtitled"Exclusivityand
Revenue
Share"states"unlessany
other
federallyrecognizedIndianNation
with
areservationlocatedwithintheState
of
New
Yorkas

theeffective
date
of
theCompactseeksa
GamingCompact
withtheState,theStateagreesthattheNationshallenjoytotalexclusivitywithregardtoelectronic
gaming

It
seems
clearthatanyexclusivitywiththeSeneca
Nation
of
Indiansisnotcreatedbythe
MOU
but
by
asubsequent
Gaming
Compact.Weall
know
thatsuchaCompacthasnotbeennegotiatedandratified
by
either
theState
of
the
Seneca
Nation.
It
isequallycleartheGovernordidnotsurrenderhisauthoritytonegotiateaCompactwithanotherIndianTribe.Quitethecontrary,the
MOU
anticipatesthattheGovernormaydoso.
