    Darren Chaker notes California record sealing can go beyond just seal, but allow records to be destroyed. “‘[Penal Code] section 851.8 is for the benefit of those defendants who have not committed a crime. It permits those petitioners who can show that the state should never have subjected them to the compulsion of the criminal law -- because no objective factors justified official action -- to purge the official records of any reference to such action. . . ...” (People v. Matthews (1992) 7 Cal.App.4th 1052, 1056.) In People v. Scott M. (1985) 167 Cal. App. 3d 688, 700, “Section 851.8 is for the benefit of those defendants who have not committed a crime.” Thus, one tactic is to displace an element of the crime arrested for, thus if done so, then no crime was committed. Once the petition is granted, the defendant can answer he has not been arrested, and all records are sealed, and ordered destroyed three years after the arrest. Great law to help those not to be burdened with an improper arrest. If the police don't agree to sealing, then the petition should be accompanied by a points and authorities.

This is especially good if the applicant had his felony reduced to a misdemenor and expunged, thus allowing to be a gun owner once again. See, www.Darren-Chaker.net for expungement info, and People v. Camarillo (2000) 84 Cal.App.4th 1386, the Court discussed the impact of a Penal Code § 17(b)(3) reduction of a felony to a misdemeanor. In its interpretation of Penal Code § 17 and specifically subsection (b)(3), the court in Camarillo reiterates that a felony reduced to a misdemeanor pursuant to that code section must be treated as a misdemeanor thereafter for all purposes unless an express statutory exception exists. “Under the rationales of these cases, a court's designation of an offense as a misdemeanor under Penal Code § 17 is controlling “for all purposes” thereafter, unless the Legislature has indicated a clear intention to the contrary.” (Id., at 1391.) In short, once a felony has been reduced, the applicant is longer a felon who is barred from owning a firearm (yay!),
