PREAMBLE
We
the
people
of
the
City
of
Bozeman
under
theconstitutionand
laws
of
the
State
of
Montana
in
orderto
secure
the
benefits
of
local
self
overnment
and
to
provide
for
an
honest
and
accountablecommssionmanager
government
do
herebyadopt
thischarter
and
confer
uponthe
city
the
following
powers
subject
to
the
following
restrictions
and
prescribed
by
the
followingprocedures
and
governmental
structure
By
this
action
we
secure
the
benefits
of
home
rule
and
self
governance
and
affirmthevalues
of
representative
democracy
professionalmanagementstrong
political
leadership
citizen
participation
and
regional
cooperation
ARTICLE
I
POWERS
OF
THE
CITY
Section
1
01
Powers
of
the
City
The
City
of
Bozemanshall
have
all
powers
possible
for
a
city
with
self
overning
powers
to
have
undertheconstitution
and
laws
of
the
State
of
Montana
as
fully
and
completely
as
though
they
were
specifically
enumerated
in
thischarter
Section
1
02
Construction
a
Powers
The
powers
of
the
city
underthis
charter
shall
be
construed
liberally
in
favor
of
the
city
and
the
specific
mention
of
particular
powers
in
the
charter
shall
not
be
construed
as
limiting
in
any
way
the
general
power
granted
in
this
article

Construction
As
provided
by
Article
XI
Section
5
of
the
Constitution
of
Montana
provisions
herein
establishing
executive
legislative
and
administrative
structure
and
organization

superior
to
statutoryprovisions

Intergovernmental
Relations
The
City
of
Bozeman
may
participate
by
contract
o
otherwise
with
any
governmentalentity
of
the
State
of
Montana
o
any
other
state
o
states
o
the
United
States
in
the
performance
of
any
activity
which
one
omoe
of
such
entities
has
the
authority
to
undertake
 
ARTICLE
II
CITY
COMMISSION
Section
2
01
General
Powers
and
Duties
All
powers
of
the
city
shall
be
vested
in
the
city
commission
except
as
otherwise
provided
by
law
o
this
charter
and
thecommission
shall
provide
for
the
exercise
thereof
and
for
the
performance
of
all
duties
and
obligationsimposed
on
the
city
by
law
Section

Eligibility
Terms
and
Composition
a
Eligibility
Only
registered
voters
whose
principal
residence
is
in
the
City
of
Bozeman
shall
be
eligible
to
hold
the
office
of
commssion
member
o
mayor
b
Terms
The
term
of
office
of
elected
officials
shall
befour
years
elected
in
accordance
with
Article
VI
c
Composition
The
commission
shall
be
composed
of
fourmembers
elected
by
the
voters
of
the
city
at
large
in
accordance
with
provisions
of
Article
VI
and
the
mayor
The
mayorshall
be
elected
as
provided
in
2
03
b
Section

Mayor

Powers

The
mayorshall
be
a
voting
member
of
the
city
commssion
and
shallattendand
preside
at
meetings
of
thecommission
represent
the
city
in
intergovernmental
relationshipspresent
an
annual
state
of
the
city
message

to
thecommssion
agenda
prepared
by
the
city
manager
assign
subject
to
the
consent
of
commssion
agenda
items
to
sub
commttees
of
the
commssion
and
perform
other
duties
specified
by
thecommssion
The
mayorshall
be
recognized
as
head
of
the
citygovernment
for
all
ceremonial
purposes
and
by
the
governor
forpurposes
of
military
law
but
shallhave
no
administrative
duties
and
shall
not
interfere
with
theadministration
of
the
city
as
provided
in
2
05
c
below
The
mayorshall
not
have
any
appointment
power
to
city
boards
except
where
required
by
state
law

Mayor
Elected
At
Large
At
every
regularcity
election
the
voters
of
the
city
shall
elect
a
mayor
at
large
for
a
term
of
four
years
The
person
so
electedshall
serve
as
deputy
mayor
and
a
commissioner
for
the
first
two
years
of
his

her
term
and
mayor
for
the
balance
of
his
o
her
term
of
office

Compensation
Expenses
The
city
commission
may
determinetheannual
salary
of
the
mayor
andcommission
members
by
ordinance
but
no
ordinance
increasing
such
salary
shallbecome
effective
until
the
date
of
commencement
of
the
terms
of
commssionmembers
elected
at
thenext
regular
