TheEvaluationCommitteehascompleteditsevaluationoftheWineKiosksprocurementusingapprovedevaluationcriteria,
in
accordancewithCommonwealthpoliciesandprocedures.Basedupontheapprovedcriteria,theEvaluationCommittee
bas
foundtheproposer'sresponsetobedeficient.Assuch,theEvaluationCommitteerecommendsthattheBoardnotenterintocontractnegotiationswiththesoleproposer,SimpleBrands,LP,forWineKiosks.Thismemorandumalsodocumentsthatallofthenecessarystepsweretakeninconductingtheprocurement
in
accordancewiththeprovisionsoftheCommonwealthProcurementCode.TotheextentthatwrittendeterminationsarerequiredundertheCodeforanyofthefollowingstepsandnoattachedrecordexists,thismemorandumshallserveaswrittenconfirmationthatsuchstepsoccurred.

DETERMINATIONTOUSECOMPETITIVESEALEDPROPOSALMETHOD:1.ThisRequestforProposals(''RFP'')providedinterestedpartieswithsufficientinformationtoenablethemtoprepareandsubmitproposalsforconsiderationbytheCommonwealthofPennsylvania("Commonwealth"),PennsylvaniaLiquorControlBoard("PLCB',),tolease,provide,maintainandservicefullyfunctionalwinekiosksforthePLCBtoplace
in
locationsthroughouttheCommonwealthdesignatedbythePLCBassatellitewinestorelocations,atnocosttotheCommonwealthlPLCB.ThekioskswillbemonitoredviaaPLCB-staffedcustomerservicesupportcenter.2.ConsistentwiththeDepartmentofGeneralServices'("DGS")strategicprocurementobjectivesandtheGovernor'spoliciestoevaluatecontractortechnicalcapabilities,disadvantagedandenterprisezonesmallbusinessparticipation,alongwithcost

awardingCommonwealthcontracts,itwas
 
determined
that
thecompetitivesealedbiddingmethodwasnotpracticableoradvantageoustotheCommonwealthlPLCBtousetoawardthiscontract.Thus,thePLeBissuedanRFPtoinstitutethecompetitivesealedproposalmethodofawardforthisprocurement.B.PUBLICNOTICE:PublicnoticeoftheRFPwasgiventhroughpostingontheDGSandPLeBwebsitesonMarch24,2008.C.EVALUATIONCOMMITTEE:
An
evaluationcommitteewasestablishedconsistingofagencyrepresentativesfromthePLCBandDGS.RepresentativesfromtheComptroller'sOfficeandOfficeofChiefCounselwereinvitedandparticipated
in
thecommittee.D.PRE-PROPOSALCONFERENCE:Amandatorypre-proposalconferencewasheldonApril16,2008at10:00a.m.EDTintheNorthwestOfficeBuilding.E.ADDENDATOTHERFP:Potential_proposersweregiventheopportunityinaccordancewithSection1-9oftheRFPtosubmitquestionsconcerningtheprocurementtotheIssuingOffice.TheofficialresponsestothequestionswereincorporatedintotheRFPbyaddendaperSection1-10oftheRFP.

A.EVALUATIONCRITERIA:TheEvaluationCommitteeestablishedtherelativeimportanceofthemajorevaluationcriteriapriortoopeningtheproposals,consistingoftechnical(82%),DomesticWorkforceUtilizationCertification(3%)andDisadvantagedBusinessparticipation(15%).B.PROPOSALOPENING:Proposalswereopenedinamannertoavoiddisclosureoftheircontents
to
competingproposers.Thesealedtechnicalproposalsweredistributedtotheevaluationcommitteeandthedisadvantagedbusiness(''DB'')proposalswereforwarded
to
theBureauofMinorityandWomenBusinessOpportunities("BMWSO'')foritsreview
and
scoring.Proposerswereaffordedapproximatelyforty-five(45)daystorespondtotheRFP.One(1)proposalwasreceivedonorbeforetheduedateofMay8,2008.C.CLARIFICATIONS/ORALPRESENTATIONS:
In
accordancewithSection1-16oftheRFP,writtenclarificationsandanoralpresentationwasrequestedfromtheproposerbasedontheinitialtechnicalevaluationtoassurefullunderstandingandresponsivenesstotheRFPrequirements.TheoralpresentationwasheldonJune16,2008.D.RESULTSOFEVALUATION:

results
of
its
technicalevaluationtotheIssuingOffice.2.TheIssuingOfficecombinedthefinaltechnicalscores,theDomesticWorkforceUtilizationCertificationscore,andthepreliminaryDBscorereceived
from
BMWBO.3.BESTANDFINALOFFERSPHASE:AsauthorizedbySection1-20oftheRFP,theproposerwasselectedto
proceed
toa"BestandFinalOffers"phaseoftheevaluationprocess.4.OVERALLSCORING:Aftercombiningthefinaltechnicalscores,theDomesticWorkforceUtilizationCertificationscores,andthe
final
disadvantagedbusinessscores,inaccordancewiththerelativeweightsassignedtotheseareasandfixedpriortotheopeningoftheproposals,tbeproposalsubmittedbySimpleBrands,
LP.
receivedatotalof305.57pointsoutof1,000.Ifapplicable,anybonuspointsforEnterpriseZoneSmallBusinessParticipationhavealsobeenincluded
in
thefinaloverallscores.Theoverallscoringforthisprocurementconcludedasfollows:
