Craig Johnson submitted a request to the Texas Department of State Health Services (DSHS) asking Commissioner David Lakey to authorize the publishing of the local school district reports of the Texas School Survey to Scribd.com, a popular document-sharing website. DSHS General Counsel Lisa Hernandez, on behalf of Commissioner Lakey, responded that they will not publish the local school district reports to the Scribd website. Mr. Johnson requested that DSHS provide him the exact policy that prevents them from publishing the documents and DSHS responded that "the Department does not have any documents responsive to your request."

The February 17, 1993 report for the Texas Commission on Alcohol and Drug Abuse state TCADA's policy of maintaining the strictest confidentiality by not releasing the survey results for the various school districts that participated in the annual Texas School Survey of Drug and Alcohol Use. (See Page 47.) TCADA existed as a separate state agency until September 2004, when it merged with the Mental Health and Substance Abuse Division of the Texas Department of State Health Services.
