 19Q.Good afternoon, Mr. Gluchowski.20A.Good afternoon.21Q.Could you please introduce yourself to the ladies22and gentlemen of the jury?23A.Hello. I'm Frank Gluchowski, and I formerly24worked as the legislative counsel to the Senate majority25from 1997 until I retired in on December 30thof 2008.

2311Q.I want to get something straight. How do you2pronounce your last name? Because there's been very3different pronunciations.4A.Phonetic. Gluchowski.5Q.Thank you very much. Mr. Gluchowski, can you tell6us about your educational background?7A.Yes. I attended law school at St. Johns8University and was graduated in 1983. Before that, I9studied at New York Institute of Technology, where I got a10Bachelor's degree.11Q.Now, you mentioned earlier that you had worked for12the New York State Legislature.13A.That is correct.14Q.When did you begin working for the New York State15Legislature?16A.That would have been in -- on April 10thof171989.18Q.What was your title when you started?19A.Well, I was the counsel to the legislative ethics20committee.21Q.Did your title change while you worked for the22legislative ethics committee?23A.Yes. At some point after a few years, I don't24remember the exact time, I became the counsel and director25of the legislative ethics committee.

2321Q.Can you tell us what the legislative ethics2committee was?3A.Yes. It was a bipartisan joint assembly of eight4members of the Legislature, meaning there were four5Democrats and four Republicans, four from the Assembly and6four from the Senate, and they were established under the7Ethics in Government Act of 1987, when it came into being in81988 at some point, but I didn't get there until 1989. And9the function of the committee was to administer financial10disclosure for legislators and employees and candidates for11the Legislature and to render advisory opinions on questions12asked by the people subject to the committee's jurisdiction13and, finally, to investigate complaints made to the14committee.15Q.You mentioned written advisory opinions. Who16drafted those opinions while you were at the committee?17A.Well, for the first few years, the initial draft18was by subordinate employee named Barry Weinstein, but I19don't think Barry stayed more than a couple of years. And20then I drafted the opinions and the opinions that Barry21drafted initially, I approved and reworked. They were22ultimately my responsibility to present to the committee.23And then at committee meetings, the committee would24sometimes change the advice or sometimes they approved it25just as it was presented.
