Minors and Crisis Counseling Page 2Fifteen year old Sandy opens the door cautiously to a rape treatment center. She isembarrassed and upset. Although she is not with her parents, she complains of beingsexually assaulted by a male friend and requests to see a counselor. She does not want totell authorities or her parents. You are the counselor on duty. What are the services thatcan be offered and what are the limitations?What should be done in Sandy’s situation? Can counseling services be offered to Sandywithout her parent’s consent? How will this service be billed? Is Sandy at an age whereservices are automatically accepted or will they be denied? What are the rules of confidentiality concerning treatment of a minor?Sandy is taken into a room for her assessment and file forms to fill out. What do you do?As stated in the Florida Statute 394.4784, the following excerpt addresses many of theissues surrounding protocol that this particular case study presents.“Minors; access to outpatient crisis intervention services and treatment.—For the purposes of this section, the disability of nonage is removed for any minor age 13 yearsor older to access services under the following circumstances:
 
Minors and Crisis Counseling Page 3(1) OUTPATIENT DIAGNOSTIC AND EVALUATION SERVICES.—When anyminor age 13 years or older experiences an emotional crisis to such degree that he or she perceives the need for professional assistance, he or she shall have the right to request,consent to, and receive mental health diagnostic and evaluative services provided by alicensed mental health professional, as defined by Florida Statutes, or in a mental healthfacility licensed by the state. The purpose of such services shall be to determine theseverity of the problem and the potential for harm to the person or others if further  professional services are not provided. Outpatient diagnostic and evaluative services shallnot include medication and other somatic methods, aversive stimuli, or substantialdeprivation. Such services shall not exceed two visits during any 1-week period inresponse to a crisis situation before parental consent is required for further services, andmay include parental participation when determined to be appropriate by the mentalhealth professional or facility.(2) OUTPATIENT CRISIS INTERVENTION, THERAPY AND COUNSELINGSERVICES.—When any minor age 13 years or older experiences an emotional crisis tosuch degree that he or she perceives the need for professional assistance, he or she shallhave the right to request, consent to, and receive outpatient crisis intervention servicesincluding individual psychotherapy, group therapy, counseling, or other forms of verbaltherapy provided by a licensed mental health professional, as defined by Florida Statutes,or in a mental health facility licensed by the state. Such services shall not includemedication and other somatic treatments, aversive stimuli, or substantial deprivation.Such services shall not exceed two visits during any 1-week period in response to a crisissituation before parental consent is required for further services, and may include parental
