Intergovernmental Review
This program is subject to ExecutiveOrder 12372 and the regulations in 34CFR part 79. One of the objectives of theExecutive order is to foster anintergovernmental partnership and astrengthened federalism. The Executiveorder relies on processes developed byState and local governments forcoordination and review of proposedFederal financial assistance.This document provides earlynotification of our specific plans andactions for this program.
Applicability of Education DepartmentGeneral Administrative Regulations(EDGAR) to AFP
In general, EDGAR would apply tothis grant except to the extent it isinconsistent with the purpose of andintent of section 4(b)(2)(D) of the ATAct. Specifically, grantees would beexempt from section 80.21(i) regardinginterest earned on advances and theaddition method in section 80.25(g)(1).Also, sections 75.560
–
75.564 would notapply to the extent that these sections of EDGAR are inconsistent with the AFPrequirement that indirect costs cannotexceed 10 percent.

TheAdvisory Committee on StudentFinancial Assistance is establishedunder Section 491 of the HigherEducation Act of 1965 as amended byPublic Law 100
–
50 (20 U.S.C. 1098).The Advisory Committee serves as anindependent source of advice andcounsel to the Congress and theSecretary of Education on studentfinancial aid policy. Since its inception,the congressional mandate requires theAdvisory Committee to conductobjective, nonpartisan, and independentanalyses on important aspects of thestudent assistance programs under TitleIV of the Higher Education Act, and tomake recommendations that will resultin the maintenance of access topostsecondary education for low- andmiddle-income students. In addition,Congress expanded the AdvisoryCommittee
’
s mission in the HigherEducation Amendments of 1998 toinclude several important areas: access,Title IV modernization, distanceeducation, and early information andneeds assessment. Specifically, theAdvisory Committee is to review,monitor and evaluate the Department of Education
’
s progress in these areas andreport recommended improvements toCongress and the Secretary.The Advisory Committee hasscheduled this one-day hearing todiscuss release of its new report relatedto its congressionally requested study tomake textbooks more affordable(Textbook Study). This one-year study,was requested by the U.S. House of Representatives Committee onEducation and Labor (formerlyEducation and the Workforce) toinvestigate further the problem of risingtextbook prices and determine theimpact of rising textbook prices onstudents

ability to afford apostsecondary education. In addition,other discussions will focus on twocomponents of the AdvisoryCommittee

s three-year InnovativePathways Study: Expected FamilyContribution and early financial aidinformation.The proposed agenda includes experttestimony and discussions by prominenthigher education community leaders,Congressional staff, staterepresentatives, and institutions on (a)the Advisory Committee

s TextbookStudy recommendations; (b) legislativeefforts to simplify the student aidapplication and delivery process; and(c) the National Advising Corps.
