1. Whether the federal “honest services” fraudstatute, 18 U.S.C. § 1346, requires the governmentto prove that the defendant’s conduct was intendedto achieve “private gain” rather than to advance theemployer’s interests, and, if not, whether § 1346 isunconstitutionally vague.2. When a presumption of jury prejudice arisesbecause of the widespread community impact of thedefendant’s alleged conduct and massive, inflamma-tory pretrial publicity, whether the government mayrebut the presumption of prejudice, and, if so,whether the government must prove beyond a rea-sonable doubt that no juror was actually prejudiced.
