Advisory opinion dated July 20, 2009 from Robert Freedom, Executive Director of the New York State Committee on Open Government. Mr. Freeman states that "I do not believe that the [CUNY Law School's] rule concerning 'holds on records' is valid." This suggests that the Law School cannot withhold records from students, even if there is an alleged record hold.
Please note that further enforcement action may be taken against the Law School by initiating an Article 78 proceeding within four months, to compel the Law School to release records requested under FOIL.
