If HUD opens up a disparate impact discrimination case, this HOA is toast. Disparate discrimination turns the burden of proof to the respondents- they have to prove they had a justified business purpose for their discriminatory actions - this should put HOA lawyers on notice that they cannot dictate land use by abusing the civil court process

We were hopeful that if any allegations contained in that letter from a Morrison Ranch resident were false or misleading, that the board and or its legal counsel would provide evidence to the contrary. We followed up with the board, since we understood it was considering appealing the Court’s decision. Specifically we asked the board if it was conversant with the Business Judgment Rule and the concept of Privileged Information. The board responded on the affirmative in both cases
