  • Discrimination in a CID environment more prevalent than you think

If HUD opens up a disparate impact discrimination case, this HOA is toast. Disparate discrimination turns the burden of proof to the respondents- they have to prove they had a justified business purpose for their discriminatory actions - this should put HOA lawyers on notice that they cannot dictate land use by abusing the civil court process

  • UCI's Office of Equal Opportunity and Diversity Boneheaded Approach to Safety

The UCI's Office of Equal Opportunity and Diversity Boneheaded Approach to Safety is a perfect illustration of what parasitic bureaucracies tend to do: Instead of looking at the cause of the problem, it focuses on the effect: Or consistent with the old adage "teach a man to fish..." - in this case, instead of hiring the right personnel for the right job, including such elementary requirements as speaking English, the parasitic bureaucracy wants the tail to wag the dog. http://cotobuzz.blogspot.com/2011/08/alice-and-california-university-at.html

  • Elder Abuse Aided and Abetted by Parasitic Bureaucracies

Rancho Santa Margarita, CA – If you want to get back at your elder parents for your own shortcoming, this is your day. According to Kathleen Wilber, USC's. Mary Pickford Professor of Gerontology, recent studies suggest that more than one in seven older adults is victimized each year. Unfortunately, such studies rarely take into account what we refer to as the parasitic bureaucracy effect – this is where a bureaucracy either to cover up its own incompetence and or to increase its sphere of influence, delays, denies and ore ignores reporters requests for transparency, as described in some of the pieces summarized below. http://www.atwebo.com/cotobuzz/2011/ELDER/CotoELDERAbuse.htm

  • A HOA Legal Mind A Terrible Thing to Waste - Assault on Free Speech

Refer to: http://www.atwebo.com/cotobuzz/2011/LEGAL/CotoLEGALSB.htm Desirous for a fair discourse on allegations of electioneering, misinformation and defamation, we sent a courtesy copy of a letter received by the CotoBuzz Journal Editor to the Morrison Ranch board of directors and its legal counsel Sandra Gottlieb, asking all to comment on the allegations, prior to publication even thought the contents of the letter had previously been published in the resident's own website. We were hopeful that if any allegations contained in that letter from a Morrison Ranch resident were false or misleading, that the board and or its legal counsel would provide evidence to the contrary. That way we would provide the facts as viewed from both sides- see for example: A HOA Legal Mind - A Terrible Thing to Waste - - WMD in Morrison Ranch

  • A HOA Legal Mind - A Terrible Thing to Waste - Appointments are not for life

Agoura Hills, CA - The ruling on Small Claims Court case LAV 11V01563 refers to small claim action filed by Jan Gerstel, challenging the Morrison Ranch board of directors claiming the board was violating the CC&Rs by having Ms. Barabara Wood as Architectural Committee chairman for over 15 consecutive years. The judge ruled in Mr. Gerstel's favor confirming the Board's actions were improper and their reason for ignoring the rules had no basis. 05/16/2011 JUDGMENT ENTERED AS A FINAL DISPOSITION ON 05/16/11 FOR (GERSTEL, JAN) . AGAINST (MORRISON RANCH BOARD OF DIRECTORS) AKA (MORRISON RANCH ESTATES HOA BOARD OF) . PRINCIPAL $ 00.00 . COSTS $ 40.00 . TOTAL $ 40.00 . "This case was never about money and as you can see, the judge understood that. It was only about getting the Board to properly follow the rules and enforce the covenants as written." said Mr. Gerstel. Refer to: http://www.atwebo.com/cotobuzz/2011/LETTERS/CotoCIDSmallClaims.htm

  • A HOA Legal Mind - A Terrible Thing to Waste - - WMD in Morrison Ranch

Example of a HOA's use of Weapons of Mass Disinformation (WMD) Refer to: http://www.atwebo.com/cotobuzz/2010/CID/CotoCIDCheck.htm Agoura Hills, CA - In the case LAV 09V07093 Jan Gerstel Vs. Morrison States Ranch HOA, the Court decided that the HOA board of directors had breached its fiduciary duty by failing to be responsive to Mr. Gerstel’s request to have the board produce board meeting minutes. We followed up with the board, since we understood it was considering appealing the Court’s decision. Specifically we asked the board if it was conversant with the Business Judgment Rule and the concept of Privileged Information. The board responded on the affirmative in both cases
