May it please your honours :This complaint petition is being filed on behalf of Mr. Mohd Azeem Khan, <89,First Floor, Suraj Apartment, Pl Prahladpur , New Delhi >, referred hereafter asComplainant, and is as follows :1.0 That this complaint Petition is being filed under Sec.2 (1)(b)(i) of the Consumer Protection Act.
 
2.1 That the Opposite Party No. 1 is the manufacturer of 'Hitachi' brand Home AirConditioners and other products for residential and commercial use, 1. (Descriptionabout the O.P)
 
2.1 That the opposite party No. 2 is engaged in the business of selling Consumerdurables like Air Conditioners, Refrigerator, TV, etc. to the public for aconsideration, apart from other activities.
 
 
(Narration of the incident)
 
3.1 That on 5
th
June 2011 (date of purchase), the complainant purchased one 'Hitachi'brand Window AC RAV 518ERD, 1.5 Ton (Details about the equipment purchased)manufactured by O.P. No. 1 from the show room of O.P. No. 2, vide Cash memoNo...(Invoice No 241 , Book No 05 , Dated 5.6.2011), a photocopy of the said documentis furnished at Annexure - I.3.2 That the Air Conditioner (AC) abruptly stopped functioning (Showing Error E9on Display) on 3

July 2012 (when)
 
and the matter was immediately reported to O.P. No. 2 and O.P. 2 has asked me toregister the complaint on Customer Care Number of O.P. 1. As per his advice thecomplaint has been registered on 3
rd
July 2012 with customer care of O.P. 1 and myrequest number is 12070300862. A photocopy of the emaCare Department is furnished at Annexure - II.3.3 On 8 May 2012 , I have also requested for Free Wet Service with Customer Caredepartment at O.P. 1 . The service person taken out the AC Unit , brought it tobathroom where he has poured water on AC Unit . When I have asked him he saidA photoof the AC clearly visible wires outside is furnished at Annexure - III.3.4 The same day on completion of service I have mentioned dissatisfied on their jobsheet for free service of O.P. 1 , signed by me.

3.5 That the Complainant immediately reported the matter to O.P. No. 1 and alsocomplained to O.P. No. 2. (Furnish important relevant documents.)
 
3.6 I have made reminder for my faulty AC successively on 5 July 2012 to CustomerCare Department , on 7
th
July I have sent a reminder and request to M/S Shivamauthorized service provider of O.P. 1 . email is furnished at Annexure - IV.3.7 I have also tried to contact Mr Varghese Joseph , Vice President Sales of O.P.1 viaemail on his personal email id
email is furnished atAnnexure - V.3.7 That the O.P. No. 1 did not bother to honour my service request till date theComplainant is suffering due to non-availability of the ACs.4.0 That the O.P.s had supplied defective good and they have to make good thelosses suffered by the complainant.
 
 
 
PRAYER
In view of the submissions contained in the preceding paragraphs, thecomplainant most respectfully prays to the Hon'ble Forum to direct the OppositeParties to :(a) refund the cost of the Air Conditioner (Ac Unit) , Rs. 28815 along with 18 %interest ;(b) pay a sum of Rs. 90,000/- towards the physical strain and mental agony sufferedby the complainant and his family members (compensation) ; and(c) pay a sum of Rs. 1,000/- towards cost of this petition (Cost) ;for which act of kindness, the complainant shall, as is duty bound, ever pray.Signature
