Does Section 3 of the Defense of Marriage Act, 1U.S.C. § 7, which defines the term “marriage” for allpurposes under federal law as “only a legal unionbetween one man and one woman as husband andwife,” deprive same-sex couples who are lawfullymarried under the laws of their states (such as New York) of the equal protection of the laws, asguaranteed by the Fifth Amendment to theConstitution of the United States?

The petitioner is Edith Schlain Windsor, inher capacity as the executor of the estate of her latespouse, Thea Clara Spyer.
