DavidsonCounty("MetroCharter")providesthat"itshallbethedutyofthemetropolitanboardofpubliceducation"toadopt"rules,regulationsandastatementofpolicies,including(a)themannerandmethodofoperatingthemetropolitanschoolsystemanditsproperties,(b)themannerandmethodofemployingpersonnel,(c)allpersonnelpoliciesandanyrequirementswithreferencetoteachingpersonnelornonteachingpersonnel...."MetroCharter

7.OnJuly25,2000,theBoardofEducationunanimouslyadoptedtheLNP(attachedheretoasExhibitB).Amongotherthings,theLNP(1)givesclassifiedandnon-certificated

non-teaching)employeesoftheBoardofEducationtherighttoform,join,andassistanyemployeeorganization;(2)allowssuchemployeestochooseanexclusiverepresentativetomeetandconferwiththeDirectorofSchoolsorhis/herdesigneeaboutthetermsandconditionsofemployment;(3)requirestheDirectorofSchoolsorhis/herdesigneetoworkingoodfaithwiththeemployeerepresentativetodevelopanon-bindingwrittenmemorandumofunderstanding("MOU");and

requirestheBoardofEducation'spayrolldepartmenttowithholdemployeeorganizationduesfromthepayofemployeeswhogivewrittenauthorization.

OnOctober23,2000,amajorityofsupportemployeesinanappropriatebargainingunitoftheMetroschoolsystemvotedtoselectSElULocal205astheirexclusiverepresentative.TheBoardofEducationsubsequentlycertifiedSEIULocal205astheexclusiverepresentative,andSEIULocal205maintainedthatstatusuntilthepresentdispute.

SEIULocal205hasenteredintoaseriesofMOUswiththeDirectorofSchools.ThelatestMOUhadaneffectiveperiodofJuly1,2008,toJune30,2011.10.
