Aydelott(Grievant)hadinappropriatecontactwithafemalehighschoolstudentin2010inviolationoftheEscambiaCountySchoolDistrictandstateofFloridaEmployeeCodesofEthics.PursuanttotheAAARulesandProceduresforLaborArbitrations,thepartieshavedesignatedJeanneCharlesWoodtohearandtodecidecertaindisputesarisingbetweenthem.ThepartiespresentedevidenceandargumentsonMarch15,2012inPensacola,Florida.Thepartieswereprovidedwithafullopportunitytoexamineandcross-examinewitnesses.Witnesseswereswornandtestifiedunderoath.TherecordwasclosedonMay12,2012upontheArbitrator'sreceiptofpost-hearingbriefs.ISSUES

ARTICLEIII.3GRIEVANCEPROCEDURESA.Levell-WorksiteTheAssociationmaypresentthegrievanceinwritingtothegrievant'simmediatesupervisorwhowillarrangeforameetingwithineight(8)daysafterreceiptofthegrievance.Thegrievant,anAssociationrepresentative,andthegrievant'simmediatesupervisormayalsorequestthatarepresentativeoftheadministrationbepresentinhisbehalf.ThesupervisormustprovidetheAssociationandthegrievantawrittenanswerwithin(8)daysfromthedateofsaidmeeting.Theanswerwillstatetherationaleforthedecision.Bymutualagreement,thetimelinesmaybeextendedtoachievethemostsuitableresolution.

3B.Level2-DistrictIftheAssociationandthegrievantarenotsatisfiedwiththedispositionofthegrievanceatLevel1,thegrievancemaybereferredtotheSuperintendent.TheSuperintendentortheSuperintendent'sdesigneeshallarrangeforameetingwithrepresentativesoftheAssociationandthegrievant(s)totakeplacewithineight(8)daysofthereceiptoftheappeal.TheSuperintendentorSuperintendent'sdesigneeshallhaveeight(8)daystoprovideawrittenanswerafterthemeetinghasbeencompleted.Theanswershallstatetherationaleforthedecision.Thistimelimitmaybeextendedonlybymutualconsentofthepatties.C.Level3-Arbitration

theAssociationisnotsatisfiedwiththedispositionofthegrievanceattheLevel2orifthetimelimitforresponseatLevel2hasexpiredwithouttheissuanceoftherequiredwrittenanswer,thegrievancemaybesubmittedwithinthirty(30)daystofinalandfindingarbitrationaccordingtotherulesoftheAmericanArbitrationAssociation.ARTICLEIlIATIMELIMITS

Sinceitisimportantthatagrievancebeprocessedasrapidlyaspossible,thenumberofdaysindicatedatanylevelshouldbeconsideredasamaximumand,everyeffortshouldbemadetoexpeditetheprocess.B.ThetimelimitsprovidedbythisArticleshallbestrictlyobserved,butmaybeextendedbywrittenagreementoftheBoardandtheAssociation.GrievancesfiledafterMayI,shallbeprocessedasexpeditiouslyaspossiblesothatthegrievancemayberesolvedpriortotheendoftheschooltermorassoonasthereafteraspractical.ARTICLE

EMPLOYEEDISCIPLINARYPROCEDURESXLIDISCIPLINEDEFINEDDisciplinaryActionshallbedefinedasanyactionthatincludes:warningconference,verbalreprimand,writtenreprimand,suspensionwithpay,suspensionwithoutpayandlordismissal.XL2PROCEDURESA.Anydisciplinaryactionshallbeadministeredonlybytheappropriateimmediateadministrator.Alldisciplinaryactionshallbeprogressive,fairandnondiscriminatory.Disciplinaryactionwhichinvolvesthemoreseveredisciplineofwrittenreprimand,suspensionsordismissalshallbeforpropercause.Forpurposesofthisagreement,"Progressive"disciplineshallmeandisciplinewhoseintentionistocorrectunacceptableornon-productivebehavior.Progressivedisciplineanticipatesthatcorrectiveactionforafirstoffensewillbeginatthelowest
