6.TroyservedascounseltotheTownthroughouttheentirebiddingprocessforNorthHill.HeadvisedanddirectedTownofficials'actionsthroughoutthatprocess.7.In2008,attheoutsetofthebiddingprocess,RichardMacDonald,.DuxburyTownManagerandchiefbiddingofficer,instructed
Troy
tooverseethebiddingprocessforNorthHilltoensurethatitwasconductedinstrictcompliancewithallapplicablelawsandregulations.8.TroyrevieweddraftsofRFPIthatwerecompiled
by
GordonCushing,theTown'sRecreationDirector,andrecommendedamendments.Oneoftheamendmentsthathedraftedandrecommended,providingthat"comparablebusinessenterprises"wouldbeeligiblebiddersalongwithcompaniesthathadmanagedgolfcourses,basbeenafocusofJohnsonGolf'sclaimsthatRFPsIandIIviolatedG.L.c.30BandevidencethattheTownviolatedG.L.c.93A.9.InOctober2008,theTownreceivedfiveproposalsinresponsetoRFP

10.InNovember2008,Townofficialsreviewedtheevaluationsandnotedthattwooftheevaluatorsbadnotcompletedtheirnon-priceevaluationsproperly.Mr.MacDonaldsoughtTroy'sadvice

thatissue.11.TroytoldMr.MacDonaldthathehadbeenadvisedbytheInspectorGeneral'sofficethattheTownshouldrejectalltheproposalsandstartover.BasedonTroy'sadvice,MacDonaldrejectedthoseproposalsandinstitutedanewprocesstoissueRFPII.12.InDecember2008,JohnsonGolfbroughtthisaction.
