This hearing took place the day before Cindy and the boys came out of hiding. Cindy's attorney, Barbara Weiser, did not tell her critical things said that would alert her to the fact that Judge Alksne would not protect Damon.
Weiser said that there had not been a 3118 investigation and that needed to be done. Alksne wouldn't agree then but did at the next hearing. Alksne said it was a very serious case with kids putting in declarations that there was rape. She said that she wanted someone to assess whether there was brainwashing or imagining. She said that it was not uncommon for moms or kids to make it up and that there were too many false allegations. This is not supported by the research which shows it is rare for mothers and children to fabricate abuse.
Henrich suggested Dr. Dess be the evaluator. Weiser suggested Geffner, but Alksne would not allow him because she didn't know him and he may take the case at a 'different angle' than what she intended. This demonstrates that only insiders can be appointed because the judges have control of what they say.
Alksne denied the TRO but left open for later, though later she would not let it be considered. She is clear that Cindy will not be able to take the children to a doctor or therapist, one of the main ways they can keep the truth from coming out. Alksne says she knows about Eric failing the polygraph and will read everything in the file. (She does not, because she later says that one incident of abuse before hiding turned into 400 after they came back, when in fact there were hundreds of reported incidents which were ignored by Smyth but were in the file).
Alksne goes along with Weiser’s understanding that the boys will be with guardians for only 2 weeks while Damon discloses the abuse to the evaluator. That was a major lie and trick to get Cindy to come back. Alksne appoints Dr. Dess saying that she is the only one who can talk to him, which she does, which is unethical.

Are you hiding something? Why don't you publish the reports by the evaluators: Dr. Murphy, Dr. Gang, CPS? Seems like you're release these documents selectively. Why did you disable comments for the transcript of the audiotape?
