the City of Tampa (the “City”) has been selected to host the 2012Republican National Convention (the “RNC”) which is scheduled to take place from August 27-30, 2012; and
WHEREAS,
the RNC is expected to attract thousands of visitors and protesters to theCity; and
WHEREAS,
an estimated 10 billion media impressions of Tampa Bay will be madeduring the RNC by the more than 15,000 members of the local, national and international media;and
WHEREAS,
the RNC will generate millions of dollars worth of economic impact for theCity; and

 WHEREAS,
the magnitude and significance of the RNC creates unique challenges forthe City that require additional regulations to assist in promoting and protecting the generalhealth, safety, and welfare of the residents and visitors of the City during the RNC; and
WHEREAS,
the City Council has determined that the following regulations arereasonable time, place and manner restrictions that will promote and protect the general health,safety, and welfare of the residents and visitors of the City during the RNC; and
WHEREAS,
duly noticed public hearings as required by law were held by the CityCouncil at which all residents and interested persons were given an opportunity to be heard.
NOW, THEREFORE,
 
BE IT ORDAINED BY THE CITY COUNCIL
 
OF THE CITY OF TAMPA, FLORIDA:
 
Section 1.
That the recitals set forth above are hereby incorporated as if fully set forth herein.
Section 2
. This Ordinance shall go into effect immediately upon becoming a law, and terminateat 12:01 a.m. eastern time on September 1, 2012. In the event that the RNC is delayed, theeffectiveness of this Ordinance shall automatically extend to 12:01 am eastern time on the dayafter the conclusion of the RNC, but shall not extend beyond 12:01 am eastern time onSeptember 8, 2012.
Section 3.
Unless more specifically stated herein, the following regulations shall be effectivetemporarily in the City of Tampa during the time period set forth above.
Section 4. Definitions.
Unless more specifically defined herein, all words and terms shallhave the meaning as provided by the City of Tampa Code of Ordinances. In the event that thereis a conflict in definitions, the stricter definition shall apply.(1)
 
 Assembly
shall mean a demonstration, speech, meeting, performance, rally, picketline, vigil or similar gathering conducted for a common purpose of personsexpressing their political, social or religious views in a City managed land, right-of-way, sidewalk or other public grounds in a place open to the general public.(2)
 
Camp or camping
shall mean the use of property for living accommodationpurposes such as sleeping, or making preparations to sleep (including laying downof bedding for the purpose of sleep), or storing personal belongings, or placingany tents or a temporary shelter on property for living accommodation purposes.(3)
 
City managed lands
shall mean City rights-of-way, sidewalks, parks, dedicatedparks, recreation facilities, environmentally endangered lands, sanctuaries,conservation areas and any other property owned, operated, or managed by theCity.(4)
 
Clean Zone
shall mean the portions of the City within the boundaries depicted inthe maps attached hereto and incorporated herein as Exhibit A. The Clean Zone

shall include all of the rights-of-way of the depicted boundaries and the abuttingproperties.(5)
 
 Department 
shall mean the City of Tampa Parks and Recreation Department.(6)
 
 Department Director 
shall mean the City of Tampa Parks and Recreation Directorand his/her designee.(7)
 
Official Parade Route
shall mean the route created by the Department Director tobe utilized for any and all parades in the Clean Zone during the specified timeperiod stated below.(8)
 
Parade
shall mean any parade, march, demonstration, protest rally, ceremony,show, carnival, exhibition, festival, race, derby, block party, celebration, publicgathering, pageant or procession of any kind or any similar activity on or uponany street, alley or other public rights-of-way.(9)
 
Public Viewing Area
shall mean the portions of the City designated by theDepartment Director as the viewing area.(10)
 
 Rights-of-way
shall mean any street, roadway, alley or portion of land set apartfor public use, vehicular travel and local convenience, which is either owned by,or dedicated to, a governmental agency by deed or plat and/or is intended ordesignated for public use.(11)
 
Severe weather 
shall mean the forecasting or occurrence of weather phenomenathat require the National Weather Service to issue a severe weather watch orwarning for weather phenomena including, but not limited to, thunderstorms,lightning storms, hurricanes, tornadoes and floods.(12)
 
Sidewalk 
shall mean that portion of a street adjacent to the curb lines or thelateral lines of a roadway and the adjacent property lines, intended for use of pedestrians.(13)
 
Special Event Permit 
shall mean an official document authorizing performanceof a specific event regulated by Chapter 28 of the City of Tampa Code of Ordinances.(14)
 
Temporary Shelter 
shall mean tents, tarps or any type of structure or cover thatprovides partial shelter from the natural elements.
Section 5. Public Gathering Generally.
Any person, entity, group, or organizationengaging in an assembly may do so in any City managed land, subject to reasonable time, place,and manner regulations as established by the City to protect public safety, persons, property, andto accommodate the interests of persons not participating in the assemblies to use the Citymanaged lands for recreational activities. Any assembly may be terminated immediately by theDepartment Director due to severe weather.
