TheGrandJurychargesthat:

AtalltimesrelevanttothisIndictment:1.TheCityofMiamiPoliceDepartment(MPD)wasadulyconstitutedpoliceagencyengaginginlawenforcementinMiami,Florida.MPDofficerswereauthorizedbyFloridalawtomakelawfularrestsandconductlegallyauthorizedsearchesandseizureswithinthejurisdictionoftheCityofMiami.2.Thedefendant,
RAULIGLESIAS,
wasanofficerwhoheldtherankofSergeantintheMPD.3.MPD'sCrimeSuppressionUnit(CSU)consistedofthreeteamsofdetectivesresponsibleforenforcingthelawsoftheStateofFloridaprohibitingdrugtrafficking.OneoftheCSU'steamswassupervisedbydefendant
RAULIGLESIAS.
 
4.DefendantRAULIGLESIASwasresponsibleforensuringthatthedetectiveswhomhesupervisedfollowedthelawsoftheUnitedStatesandtheStateofFlorida.COUNT1(ConspiracyAgainstCivilRights)1.TheGeneralAllegationssetforthinparagraphs1-4ofthisIndictmentarereallegedandincorporatedbyreferenceintothisCountasthoughfullysetforthherein.2.OnoraboutJanuary27,2010,inMiami-DadeCounty,intheSouthernDistrictofFlorida,thedefendant,RAULIGLESIAS,whileactingundercoloroflaw,didknowinglyandwillfullycombine,conspire,confederate,andagreewith"R.M.,"alawenforcementofficer,toinjure,oppressandintimidate"R.H."inthefreeMannerandMeansoftheConspiracyexerciseandenjoymentoftherightsandprivilegessecuredtohimbytheConstitutionandlawsoftheUnitedStates,namely,therighttobefreefromunreasonableseizure.3.
It
wasapartoftheconspiracythatthedefendantwouldcausethearrestof"RH.,"OvertActsthenobtainabagofcocainetouseasevidenceagainst"R.H.,"andfalselyclaimthatthecocainewasfoundonandseizedfromthepersonof"RH."4.Infurtheranceoftheconspiracyandtoachievetheobjectthereof,atleastoneoftheco-conspiratorscommittedandcausedtobecommittedintheSouthernDistrictofFlorida,atleastoneofthefollowingovertactsonoraboutJanuary27,2010:a.RAULIGLESIASorderedOfficersAandBtoarrest"RH."eventhoughOfficerBhadsearched"RH."·andfoundnocontrabandonthepersonof"RH."
