January4,2011,basedonacomplaintfiledbyRambusInc.ofSunnyvale,California(“Rambus”),
allegingaviolationofsection337intheimportation,saleforimportation,andsaleWithinthe
UnitedStatesafterimportationofcertainsemiconductorchipsandproductscontainingthesame.
76Fed.Reg.384(Jan.4,2011).ThecomplaintallegedtheinfringementofvariousclaimsofpatentsincludingU.S.PatentNos.6,470,405;6,591,353;7,287,109(collectively,“theBarthpatents”);andNos.7,602,857;and7,715,494(collectively,“theDallypatents”).TheBarth
patentsshareacommonspecification,asdotheDallypatents.ThenoticeofinvestigationnamedasrespondentsFreescaleSemiconductorofAustin,Texas(“Freescale”);BroadcomCorp.of
 
Irvine,California(“Broadcom”);LS1CorporationofMilpitas,California(“LS1”);MediatckInc.ofHsin-Chu,Taiwan(“l\/Iediatek”);NVIDIACorp.ofSantaClara,California(“NVIDIA”);

Theinvestigationhassincebeenterminatedagainstmanyoftherespondentsonthebasisof
Rambus’ssettlementswithBroadcom,Freescale,MediaTek,andNVIDIA.LSIandSTMicroaretheonlytwomanufacturerrespondentsremaining.WiththemasrespondentsaretheircustomersAsustekComputer,Inc.andAsusComputerInternational,Inc.;
CiscoSystems,Inc;GanninInternationallnc.;Hewlett—PackardCompany;HitachiGlobal
StorageTechnologies;andSeagateTechnology.p
OnMarch2,2012,theALJissuedthenalID.TheIDfoundnoviolationofsection337for
severalreasons.Alloftheassertedclaimswerefoundtobeinvalidorobviousinviewoftheprior
artunder35U.S.C.§102or103.TheBarthpatentswerefoundtobeunenforceableunderthe
doctrineofuncleanhandsbyvirtueofRambus’sdestructionofdocuments.TheIDalsofoundthatRambushadexhausteditsrightsundertheBarthpatentsastocertainproductsofone
respondent.TheIDfoundthatalloftheassertedpatentclaimswereinfringed,andrejectednumerousaffirmativedefensesraisedbytherespondents.OnMarch19,2012,Rambus,therespondentsandtheCommissioninvestigativeattomey(“IA”)eachledapetitionforreviewoftheID.OnMarch27,2012,thesepartieseachledaresponse
totheotherspetitions.OnMay3,2012,theCommissiondeterminedtoreviewtheIDinitsentirety.77Fed.Reg.
27,249(May9,2012).Thenoticeofreviewaskedthepartiestobriefcertainquestions.Havingexaminedtherecordofthisinvestigation,includingtheALJ’sfinalID,thepetitionsforreviewandtheresponsesthereto,andthebrienginresponsetothenoticeofreview,the
Commissionhasdeterminedtoterminatetheinvestigationwithafindingofnoviolationofsection
337.
TheCommissionhasdeterminedtofindnoviolationofsection337forthefollowingreasons:WeaffirmtheALJ’sconclusionthatalloftheassertedpatentclaimsareinvalidunder35U.S.C.§
102or103,exceptfortheassertedDallymultiple-transmitterclaimsC857claims11-13,32-34,50-52),forwhichwefindthatRambushasnotdemonstratedinfringement.WereversetheALJ’s
determinationthatRarnbushasdemonstratedtheexistenceofadomesticindustryunder19U.S.C.
§1337(a)forboththeBarthpatentsandDallypatents.WeaffirmtheALJ’sdeterminationthat
theBarthpatentsareunenforceableunderthedoctrineofuncleanhands.WeaffirmtheALJ’sfindingofexhaustionoftheBarthpatentsastoonerespondent.TheCon1mission’s
determinations,includingnon—dispositivefindingsnotrecitedabove,willbesetforthmorefullyin
theCommissionsopinion._
