2.PlaintiffKELLYHANLIN'srightswerewhenofficersoftheNEWYORKCITYPOLICEDEPARTMENT("NVPD")unconstitutionallyandwithoutanylegalbasisusedgratuitous,unlawfulforceagainsthimandinterferedwiththelawfulexerciseofhisFirstAmendmentrightsByreasonofdefendants'actions,includingtheirunreasonableuseofforce,Mr.HANLINwasdeprivedofhisconstitutionalandcommonlawrights.3.Specifically,onSeptember24,2011,Mr.HANLINparticipatedinademonstrationinsupportoftheOccupyWallStreetmovement.As

HANLINandotherdemonstratorsattemptedleaveUnionSquarePark,NVPDofficersusedorangenettingtore-routeandunlawfullydetaindemonstratorsastheyattemptedtoexercisetheirFirstAmendmentrights.WhileMr.HANLINwasnotpennedinbyNYPD'sorangenetting,heobservedseveralpoliceofficersusingunlawfulforceagainstdemonstratorsandbystandersalike.Inparticular,

StreetandUniversityPlace.Disturbedbythepoliceconduct,
