ROM:SUBJECT:BALLOTPROPOSAL-DIVISIONSTREETPROJECTAttachedisamemofromLaurenTrible-Laucht,CityAttorney,regardingtheattachedballotproposalresolutionpreparedbyherbasedupondirectionfromtheCityCommissionattheJuly23,2012,StudySession.YouwillrecallthatthecityneedsapprovalfromthevoterstodisposeoftheparklandbeforetheMichiganDepartmentofTransportationwillcreateaplanforDivisionStreetImprovements.Withtheelectorate'sapproval,theCityCommissionwouldthenhavetheoptionofconsideringaplanthatwouldbe(preparedbyMDOTpost-election.JustbecausetheCityCommissionwouldhavethatauthority,ifgrantedbytheelectorate,doesn'tobligatetheCityCommissiontomoveforward.TheCityCommissionwouldultimatelyhavethedecision-makingauthorityonwhat,ifany,projectmovedforward.InorderforthisballotproposaltoappearontheNovember6,2012,GeneralElectionBallot,theCityClerkhasindicatedtheCityCommissionwouldneedtoapprovetheballotlanguagebyAugust27,2012.Irecommendthefollowingmotion:
