OnoraboutDecember22,2011,theIndependentReviewBoard("IRB")issuedareportandrecommendationtoInternationalBrotherhoodofTeamsters("IBT")GeneralPresidentJamesP.HoffathatOswaldMartucci,Local669'sSecretaryTreasurerandPrincipalOfficer,bechargedwithembezzlementandbreachinghisfiduciarydutybyconvertingLocal669'sfundstohispersonaluseandbytakingtravelallowancesfromtheLocalwithoutsubmittingproperor,forapproximatelyoneyear,anybusinessexpensereceipts,aswasrequiredbytheLocal'stravelpolicy.ThereportallegesthatbetweenFebruary2006andMayof2010,BrotherMartucciimproperlyconvertedatleast$6,184.00bysubmittingfalse"generic"businessexpensereceiptstoLocal669inordertoavoidrepaymentofunusedtravelallowanceshereceivedandbychargingexpensesontheLocal'screditcardforwhichhehadalsoreceivedtravelexpenseadvances.ThereportfurtherallegesthatbetweenJulyof2010andAugustof2011,BrotherMartucciaccepted$1,950.00intravelallowancesandprovidednoreceiptsforwhathespent,aswasclearlyrequiredbytheLocal'sexistingpolicy.TherecommendedchargesallegethatbyengagingintheforegoingconductBrotherMartucciviolatedArticleII,Section2(a)andArticleXIX,Sections7(b)(1),(2)and(3)oftheIBTConstitutionandArticleXVI,Section1(B)andXVIII,Section2ofLocal669'sBylaws.GeneralPresidentHoffapromptlyfiledtherecommendedcharges,andappointedaHearingPanel("Panel")comprisedofthefollowinguninvolvedmembers:ChuckWhobrey,PresidentofLocal215;MikeMcGaha,PresidentofLocal391andJoeGronek,SecretaryTreasurerofLocal402.BrotherWhobreywasdesignatedtoserveasthePanel'schair.ThePanelwasgiventheresponsibilityofhearingtheevidenceandmakingafullreporttoGeneralPresidentHoffa.ByletterdatedJanuary25,2012,GeneralPresidentHoffanotifiedBrotherMartuccithatahearingonthechargeswasscheduledforMarch1,2012.
 
ThehearingwasconductedonMarch1,2012attheofficesofJointCouncil18,locatedat890ThirdStreet,Albany,NewYork.Allpartieswerepresentatthehearing,andhadtheopportunitytosubmitevidenceandtestimony,crossexaminewitnessesandpresentargumentsinsupportoftheirpositions.ThechargeswerepresentedbyRolandR.Acevedo,Esq.;BrotherMartucciwasrepresentedbyattorneyStephenR.Coffey,Esq.ThePanelcommendsbothattorneysfortheirprofessionalpresentations.Thefollowingfindingsandrecommendationsarebasedontheentirerecordinthiscase,includingexhibitsandsworntestimonyappendedtoIRB'sreport,thetranscriptoftestimonyatthePanelhearing,otherdocumentsenteredintoevidence,thePanel'sconsiderationofthewitnesses'testimonyanddemeanorandtheargumentsofcounsel.

hasapproximately724members.Itrepresentsdriversanddeliveryemployeesinthebeverageandbakeryindustries.BrotherMartuccijoinedLocal669in1988.HewaselectedtotheofficeofVicePresidentin1995,andbecameafulltimeemployeeoftheLocalin2000,whenhealsoheldtheofficeofPresident.In2009,hewasappointedtotheofficeofSecretary-Treasurer,theLocal'sprincipalofficer.HealsoservesasaTrusteeofJointCouncil18andasaTrusteeoftheUpstateNewYorkBakeryDriversPensionFund.HeistheonlyofficerofLocal669whoisalsoemployedbytheLocal.
IRB'sReferral
Atalltimespertinenttothecharges,Local669'spolicyconcerningbusinessexpensesfortheLocal'sofficersprovidedforatravelallowancetobeadvancedtotheofficerinvolvedwhowasthenrequiredtoprovidereceiptsforexpensesincurredandreturnanyunusedfunds.ThispolicywasadoptedinMayof2004.ThereisnoevidencethattheLocal'sExecutiveBoardapprovedachangeinthispolicypriortoAugust22,2011,whentheExecutiveBoardapprovedwhatappearstobea"perdiem"expensepolicy.Underthisnewpolicy,officerstravelingonUnionbusinessarepaidaspecifieddailytravelallowancewhichistreatedasincometothem.Theyarenotrequiredtosubmitreceiptsandrebateadvancedfundsthatarenotspent.-2-

IRB'sreportallegesthatBrotherMartucciviolatedtheLocal's2004expensepolicyinanumberofrespects.BetweenFebruaryof2006andMayof2010,hesubmittednotfewerthan39inappropriateorfraudulentreceiptswhichhecreatedafterthefacttoavoidrebatingunspenttravelallowancefunds.Thesereceiptsdidnotidentifytheestablishmentatwhichtheexpensesweresupposedlyincurred,whowaspresent,whattheexpenseswerefor,whatUnionpurposeexistedand,inatleast11instances,eventhedatesonwhichtheexpenseswereincurred.Inotherinstancesduringthistimeframe,BrotherMartucciallegedlychargedexpensesonhisUnioncreditcardthatwerecoveredbythetravelallowanceshehadalreadyreceived,thusessentiallybillingtheLocaltwiceforthesameexpenses.Infurtherinstances,BrotherMartuccisubmittedreceiptsforitemsthatwereclearlypersonalinnatureasiftheywereproperUnionexpenses,usingthemtoavoidormitigatehisobligationundertheUnion'spolicytorebatetotheLocalunspentfundsthathadbeenadvancedtohim.IRBallegesthatthetotalamountthatMartucciimproperlyconvertedtohisownuseduringthistimeframewas$6,184.00,whichincludestraveladvancesheshouldhaverebatedtotheLocalandexpenseshechargedontheUnioncreditcardthatwerealreadycoveredbyhistraveladvances.Furthermore,IRB'sreportallegesthatbeginninginapproximatelyJulyof2010,afterIRBhadconductedabooksandrecordsexaminationattheLocal,theLocalbeganpayingofficersapurported"perdiem"allowancewhentravelingonUnionbusiness.Theseallowancesweretreatedasincometotheofficersreceivingthem,andtheofficerswerenotrequiredtodocumentexpenditureswithreceipts.Thischangeinpracticewasnot,however,formallyadoptedbytheLocal'sExecutiveBoardatthattime.TheLocal'sminutesdonotreflectformalactiononthischangeuntilAugustof2011.IRBallegesthatduringtheperiodbetweenJulyof2010andAugustof2011,BrotherMartuccitooktravelallowancesof$1,950.00,andprovidednoreceiptsdocumentinghisexpenses.AdditionalEvidenceandContentionsAtthehearing,argumentswereadvancedonBrotherMartucci'sbehalf,includingthefollowing:•ThatBrotherMartucci'ssubmissionofso-called"generic"receiptsbetween2006and2010waspursuanttopastpractice.•ThatBrotherMartucci'sactionswere"mistakes."
