Remarks and Comments: The subject site, consisting of 123 acres of the KD Range fan outside the installation boundary, was never owned or possessed by, or under the jurisdiction of, DOD. The property for the KD Range was State School lands prior to the establishment of the Camp Williams Reservation, and the subject 123 acres became privately owned after Camp Williams was established, and is still privately held. No other documentation of DOD property acquisition such as a lease or use permit was identified.

FINDINGS OF FACT

1. The federal government withdrew and reserved approximately 18,700 acres of public domain lands for a military reservation by Executive Order No. 1922 dated 24 April 1914. Under the jurisdiction of the War Department, this property was to be used by the National Guard of Utah as a target range and for joint exercises with the U.S. military. 2. The Known Distance (KD) Range was used from 1950 through 1985 as a small arms training range having 200-, 300-, and 500-meter courses with concrete barriers. The majority of this range is located within the current installation boundary and operational range area of Military Training Area (MTA) Camp Williams, but a small portion of the range fan, approximately 123 acres, extends beyond the northern installation boundary. It is located in the north 1/2 of Section 19, Lots 2, 3, 4, 7, 8, 9, and 10, Township 4S, Range lW, Salt Lake Meridian, and is very distant from the firing and target portion of the former range. The 123-acre portion of the fan overlaps private lands that were within the larger area specified for withdrawal by Executive Order 1922 but were never acquired by the Department of Defense (DOD). No other documentation of DOD property acquisition such as a lease or use permit was identified. 3. As the property for the KD Range was never acquired by DOD, it also has not been disposed by DOD. The site has been, and still is, privately held. Current owners are the Malibu and Laguna Investment Companies.
DETERMINATION

Based on the foregoing Findings of Fact, the 123-acre KD Range site has been determined to have not been under the jurisdiction of the Secretary of Defense and owned by, leased to, or otherwise possessed by the United States prior to 17 October 1986. The property is therefore ineligible for inclusion into

otherwise possessed by the United States prior to 17 October 1986. The property is therefore ineligible for inclusion into the Defense Environmental Restoration Program - Formerly Used Defense Sites, established under 10 USC 2701 et seq.

SITE LOCATION: The Camp Williams Utah National Guard Reservation is located 26 miles south of Salt Lake City in both Salt Lake County and Utah County, Utah along the Traverse Mountains. The Camp Williams Reservation can be accessed by heading west off Exit 291 from Interstate 15, onto Federal Highway 50 for approximately 1 mile to Redwood Road (Highway 68), then hleading south about 5 miles to the entrance gate. BACKGROUND INFORMATION: By Executive Order No. 1922 (dated 24 April 1914, the federal government withdrew and reserved approximately 18,700 acres of public domain lands, the title to which was in the United States, to establish a military reservation for the use of the National Guard of Utah and for joint exercises with the U.S. military. The State of Utah purchased 153 acres of land in 1927 and 199 acres of land in 1931 within the reservation boundary to be used for the garrison area of Camp Williams. Beginning in 1927, facilities were constructed to support the training of Utah National Guard units. The installation was named Camp Williams in 1928. On 27 February 1929, the War Department granted a license to the State of Utah, covering about 6,140 acres of the eastern half of the area described in the Executive Orders, to use and occupy for the purpose of training the Utah National Guard. The War Department had acquired the use of 2,360 acres of public domain land and purchased 2,288 acres of privately owned land within the reservation boundary by 12 January 1942. During World War I1 (WW 11), Camp Williams became a sub-post of Fort Douglas and was used for training of Army troops while National Guard units were away at war. The facility was returned to the Utah National Guard in 1944, and training has continued at the camp to the present time. Facilities and operations at Camp Williams include training ranges, small arms and

artillery firing ranges, mortar and hand grenade ranges, a demolition range, a heliport, combat landing strip, Basic Airborne facility, warehouses and maintenance facilities, and the Army Garrison area. The Camp Willnams Reservation is still DOD controlled, except for portions owned by the State of Utah, mostly the garrison area. The "Camp W.G. Williams Land Exchange Act of 1989" was enacted in order to effect the exchange of federal lands outside the: defined boundary of Camp Williams, that were originally withdrawn by Executive Order, for private lands still existing within the Camp Williams boundary. The goal of this exchange was to create uniform and complete lands under the Department of the Army within the camp boundary to facilitate use of the property by the Utah National Guard. This Congressional Act also revoked Executive Order 1922 of 24 April 1914 only for lands outside of the camp boundaries. These outlying lands were to be returned to the public domain after certification by the Army that they were safe. Subsequently, the process of land exchange has been ongoing since 1989. This has resulted in the "disposal" of federal (DOD) property outside of the defined camp boundary. The federal property to be exchanged for other public and private properties is depicted in a map provided by the Utah National Guard Military Department in Draper, Utah (see Real Estate Documentation). The Bureau of Land Management (BLM) Utah State Office in Salt Lake City, Utah was requested on 18 July 2000 to perform a "property boundary survey" for Camp Williams, Utah. This survey was performed by the BLM based on the Camp Williams real estate land exchange map and deed research in Salt Lake and Utah Counties. The current property boundary for Camp Williams was determined using this BLM property boundary survey. Recently, a Closed, Transferring, and Transferred (CTT) Range/Site InvenltoryReport for the Camp Williams, Utah, Military Training Area (MTA) was prepared for the U.S. Army Corps of Engineers (USACE), Sacramento District. The CTT report was developed under the Military Munitions and Response Program (MMRP) to provide an inventory of CTT ranges and sites at Camp Williams with unexploded ordnance (UXO), discarded military munitions (DMM), and munition constituents (MC). During the rangelsite inventory evaluation, it was determined that three rangeslsites might qualify for the Formerly Used Defense Sites (FUDS) program. These sites were the Known Distance (KD) Range, Southeast Simulated Attack Area, and Wood Hollow Training Area. Subsequently, Property Eligibility Reports were prepared to evaluate additional information regarding these rangeslsites to determine if they should be addressed under the Active Installations MMRP or the FUDS MMRP. The conclusions of the Property Eligibility Reports are as follows: Known Distance (KD) Range - This range may be eligible for inclusion in the FUDS program. This conclusion is based on the assumptions that the range was acquired as a result of Executive Order 1922 withdrawing public lands for use by the Utah National Guard, and that the range property was disposed prior to 17 October 19'86, the cut-off date to be eligible for the DEW-FUDS program. There were discrepancies in acquisition information, and no evidence of official deactivation or disposal was located.

Southeast Simulated Attack Area - This site is ineligible for inclusion in the FUDS program. It was determined that the actual location of this site is within the current installation boundary and the operational range of MTA Camp Williams, and is not eligible for the MMRP. Wood Hollow Training Area - This site is recommended for inclusion in the FUDS program. This conclusion is based on the assumptions that the range was acquired as a result of Executive Order 1922 withdrawing public lands for use by the Utah National Guard, and that the site property was dlisposed prior to 17 October 1986. There were discrepancies in acquisition information, and no evidence of official deactivation or disposal was located. SITE VISIT: The purpose of the visit was to research records pertaining to the acquisition and disposal of the KD Range and the Wood Hollow Training Area sites to evaluate their potential FUDS eligibility. Available records were reviewed at the Utah Army National Guard, Camp Williams; the Salt Lake County Recorders office; and the Utah State Bureau of Land Management (BLM) office in Salt Lake City. Property issues were also discussed with Utah Army National Guard and Utah Department of Environmental Quality personnel. FINDINGS: All of the information cotllected during the site visit was evaluated with regard to FUDS eligibility issues, and the findings for the KD Range and Wood Hollow Training Area are presented below. KD Range: According to information from the CTT Range Inventory, the KD Range was used from 1950 through 1985 as a small arms training range having 200-, 300-, and 500-meter courses with concrete barriers. The range fan extended to the north-central boundary of MTA Camp Williams. The majority of this range is located within the current installation boundary and operational range area. A small portion of the fan, approximately 123 acres, extends beyond the northern installation boundary on property that is currently owned by private parties. Figure 2 from the Property Eligibility Report shows the entire KD Range and the portion that extends beyond the current Camp Williams installation boundary. This Figure is titled "Range Discrepancy Map" because there was a discrepancy between the presumed original location of the range and the corrected range location. The smaller, shaded, range fan overlap shown in Figure 2, and not the larger shaded overlap, is considered to be correct in the Property Eligibility Report. According to available records, this smaller 123-acre overlapping portion of the fan is not on any federally owned (BLIM) property that was included in the 1914 land withdrawal under Executive Order 1922. Instead, it is on private lands that were within the larger area specified for withdrawal by Executive Order 1922 but were never acquired by the Department of Defense (DOD). This larger area consisted of 32,640 acres (51 sections), of which 18,700 acres were federally owned. Table 1 presents a chronological history of ownership for the property comprising the KD Range site based on records available at the Utah Army National Guard, Camp Williams, and the Salit Lake County Recorder's office. The 123-acre KD Range site is located in Township 4S, Range 1W,

Salt Lake Meridian, north 112 of Section 19, Lots 2, 3, 4, 7, 8, 9, and 10. Figure 3 from the Property Eligibility Report shows the location of the KD Range site with respect to these lots. Parcel numbers and lot numbers (G.L. 1, etc.) are listed. The chronological history provides documentation that the property in question for the KD Range was State School lands prior to the establishment of the Camp Williams Reservation, and then became privately owned after Camp Williams was established, and is still privately held. No other documentation of DOD property acquisition such as a lease or use permit was identified. Therefore, while DOD may have used the portion of the KD Range fan that extends beyond the current Camp Williams installation boundary, the property was never under the jurisdiction of DOD, and is therefore not eligible for the DEW-FUDS program. In addition, because the portion of the KD Range extending beyond the current installation boundary is the far end of the specified range fan, which is very distant from the firing and target portion of the former range, it is unlikely that this portion was ever impacted by over-fire during small arms target practice. This was confirmed in discussions with Lt. Vince Wolff, Facility Manager, Camp Williams. There are no records of findings of munitions and explosives of concern (ME@) in the KD Range fan area outside the installation boundary.

Wood Hollow Training Area: According to information from the CTT Range Inventory, the Wood Hollow Training Area was used from 1930 to 1945 by the U.S. Army as an artillery impact area. The site straddled the north-central boundary of MTA Camp Williams so that part of the site, approximately 59 acres, extendled beyond the northern installation boundary. Figure I from the Property Eligibility Report shows the portion of the Wood Hollow Training Area site that extends beyond the: current Camp Williams installation boundary. Most of the site beyond the northern installation boundary was located on federal land that had been withdrawn in 1914 under Executive Order 1922: the north '/z of Section 19, Lot 1, and the north '/z of the northwest % of Section 20 in Township 4S, Range 1W, Salt Lake Meridian. A small piece was located on of private property: Lot 10 in the north '/z of Section 19. Therefore, the portio~n the site on federal land is considered to have been fbrmally acquired and under the jurisdiction of the DOD, while the smaller portion located on private land is not considered to have been acquired. Figure 2 from the Property Elfgibility Report shows the Wood Hollow Training Area site with respect to this property, and Table 2 presents a chronological history of ownership for the Section 19 and 20 property comprising the Wood Hollow Training Area site based on records available at the Utah Army National Guard, Camp Williams, and the Salt Lake County Recorder's office. Refer to Table 1 for a history of Lot 10 of Section 19. There is evidence of DOD use of the Wood Hollow Training Area site: intact 75-mm artillery rounds were found on the site in 2001. However, review of available records has confirmed that the portion of federal land beyond the northern installation boundary was disposed after 17 October 1986 under the "Camp W.G. Williams Land Exchange Act of 1989" where federal lands outside the defined boundary of Camp Williams that were originally withdrawn by Executive Order were exchanged for private lands still existing within the Camp Williams boundary. This disposal occurred in 1994. Therefore, while the portion of the Wood Hollow Training Area that extends beyond the current Camp Williams installation boundary and located on federal land may have been

acquired and used by DOD, the property was disposed after the 17 October 1986 cut-off date and is therefore not eligible for the DERP-FUDS program.

In summary, neither the KD Range nor the Wood Hollow Training Area sites have been found to be eligible under DERP-FUDS based on property acquisition and disposal records. The portions of these sites outside of the installation boundary identified in previous reports may have been used by DOD for range activities, but were either not owned, leased or otherwise possessed by DOD, or were possessed but disposed after 17 October 1986.
