1.
Title.
Thismeasureshallbeknownandmaybecitedasthe"CaliforniansAgainstSexualExploitationAct("CASEAct")."
SEC.2.FindingsandDeclarations.
ThepeopleoftheStateofCaliforniafindanddeclare:1.Protectingeverypersoninourstate,particularlyourchildren,fromallformsofsexualexploitationisofparamountimportance.2.Humantraffickingisacrimeagainsthumandignityandagrievousviolationofbasichumanandcivilrights.Humantraffickingismodernslavery,manifestedthroughtheexploitationofanother'svulnerabilities.3.Upwardsof300,000Americanchildrenareatriskofcommercialsexualexploitation,accordingtoaUnitedStatesDepartmentofJusticestudy.Mostareenticedintothesextradeattheageof12to14yearsold,butsomearetraffickedasyoungasfouryearsold.Becauseminorsarelegallyincapableofconsentingtosexualactivity,theseminorsarevictimsofhumantraffickingwhetherornotforceisused.4.WhiletheriseoftheInternethasdeliveredgreatbenefitstoCalifornia,thepredatoryuseofthistechnologybyhumantraffickersandsexoffendershasallowedsuchexploitersanewmeanstoenticeandpreyonvulnerableindividualsinourstate.5.Weneedstrongerlawstocombatthethreatsposedbyhumantraffickersandonlinepredatorsseekingtoexploitwomenandchildrenforsexualpurposes.6.Weneedtostrengthensexoffenderregistrationrequirementstodeterpredatorsfromusingtheinternettofacilitatehumantraffickingandsexualexploitation.
SEC.3.PurposeandIntent.
ThepeopleoftheStateofCaliforniadeclaretheirpurposeandintentinenactingtheActtobeasfollows:1.Tocombatthecrimeofhumantraffickingandensurejustandeffectivepunishmentofpeoplewhopromoteorengageinthecrimeofhumantrafficking.2.Torecognizetraffickedindividualsasvictimsandnotcriminals,andtoprotecttherightsoftraffickedvictims.

3.Tostrengthenlawsregardingsexualexploitation,includingsexoffenderregistrationrequirementstoallowlawenforcementtotrackandpreventonlinesexoffensesandhumantrafficking.SEC.4.Section1161isaddedtotheEvidenceCode,toread:1161.(a)Evidencethatavictimofhumantrafficking,asdefinedinSection236.1ofthePenalCode,hasengagedinanycommercialsexualactasaresultofbeingavictimofhumantraffickingisinadmissibletoprovethevictim'scriminalliabilityforanyconductrelatedtothatactivity.(b)Evidenceofanysexualhistoryorhistoryofcommercialsexualactofavictimofhumantrafficking,asdefinedinSection236.1ofthePenalCode,isinadmissibletoattackthecredibilityorimpeachthecharacterofthevictiminanycivilorcriminalproceeding.SEC.5.TheheadingofChapter8(commencingwithSection236)ofTitle8ofPart1ofthePenalCodeisamendedtoread:Chapter8.FALSEIMPRISONMENTANDHUMANTRAFFICKINGSEC.6.Section236.1ofthePenalCodeisamendedtoread:236.1.(a)AnypersonwhodeprivesorviolatesthepersonallibertyofanotherwiththeintenttoeffectormaintainafelonyviolationofSection266,266h,266i,267,3.11.4,or51g,ortoobtainforcedlabororservices,isguiltyofhumantraffickingandshallbepunishedbyimprisonmentinthestateprisonforfive,eight,ortwelveyearsandafineofnotmorethanfivehundredthousanddollars($500,000).(b)Exceptasprovidedinsubdivision(c),aviolationofthissectionispunishablebyimprisonmentinthestateprisonforthree,four,orfiveyears.(c)Aviolationofthissectionviherethevictimofthetraffickingwasunder1gyearsofageatthetimeofthecommissionoftheoffenseispunishablebyimprisonmentinthestateprisonforfour,siK,oreightyears.(d)(1)Forpurposesofthissection,oolawfuldeprivationorviolationofthepersonallibertyofanotherincludessubstantialandsustainedrestrictionofanother'slibertyaccomplishedthroughfraud,deceit,coercion,violence,duress,menace,orthreatofunlavrfulinjurytothevictimortoanotherperson,undercircumstances'.",herethepersonreceivingorapprehendingthethreatreasonablybelievesthatitislikelythatthepersonmakingthethreatvlOuldcarryitout.(2)Duressincludesknowinglydestroying,concealing,removing,confiscating,orpossessinganyactualorpurportedpassportorimmigrationdocumentofthevictim.(e)Forpurposesofthissection,"forcedlabororservices"meanslabororservicesthatareperformedorprovidedbyapersonandareobtainedormaintainedthroughforce,fraud,orcoercion,orequivalentconductthatwouldreasonablyoverbearthewilloftheperson.2
 
(b)AnypersonwhodeprivesorviolatesthepersonallibertyofanotherwiththeintenttoeffectormaintainaviolationofSection266,266h,266i,266j,267,311.1,311.2,311.3,311.4,311.5,311.6,or518isguiltyofhumantraffickingandshallbepunishedbyimprisonmentinthestateprisonforeight,fourteen,ortwentyyearsandafineofnotmorethanfivehundredthousanddollars($500,000).(c)Anyp~rsonwhocauses,induces,orpersuades,orattemptstocause,induce,orpersuade,apersonwhoisaminoratthetimeofcommissionoftheoffensetoengageinacommercialsexact,withtheintenttoeffectormaintainaviolationofSection266,266h,266i,266j,267,311.1,311.2,311.3,311.4,311.5,311.6,or518isguiltyofhumantrafficking.Aviolationofthissubdivisionispunishablebyimprisonmentinthestateprisonasfollows:(1)Five,eight,ortwelveyearsandafineofnotmorethanfivehundredthousanddollars($500,000);or(2)Fifteenyearstolifeandafineofnotmorethanfivehundredthousanddollars($500,000)whentheoffenseinvolvesforce,fear,fraud,deceit,coercion,violence,duress,menace,orthreatofunlawfulinjurytothevictimortoanotherperson.Cd)Indeterminingwhetheraminorwascaused,induced,orpersuadedtoengageinacommercialsexact,thetotalcircumstances,includingtheageofthevictimandhisorherrelationshiptothetraffickeroragentsofthetrafficker,andanyhandicapordisabilityofthevictim,shallbeconsidered.Ce)Consentbyavictimofhumantraffickingwhoisaminoratthetimeofthecommissionoftheoffenseisnotadefensetoacriminalprosecutionunderthissection.CDMistakeoffactastotheageofavictimofhumantraffickingwhoisaminoratthetimeofthecommissionoftheoffenseisnotadefensetoacriminalprosecutionunderthissection.

TheLegislaturefindsthatthedefinitionofhumantraffickinginthissectionisequivalenttothefederaldefinitionofasevereformoftraffickingfoundinSection7102(8)ofTitle22oftheUnitedStatesCode.(g)(1)Inadditiontothepenaltyspecifiedinsubdivision(c),anypersonwhocommitshumantraffickinginvolvingacommercialsexactwherethevictimofthehumantrafficking',:vasunder18yearsofageatthetimeofthecommissionoftheoffenseshallbepunishedbyafineofnotmorethanonehundredthousanddollars($100,000).(2)Asusedinthissubdivision,"oommeroialsexaot"meansanysexualoonduotonacoountofwhiohanythingofvalueisgivenorreoeivedbyanyperson.(h)EveryfineimposedandoolleotedpursuanttothisseotionshallbedepositedintheViotimWitnessl\ssistanoeFundtobeavailableforappropriationtofundservioesforviotimsofhumantraffioking.Atleast50peroentofthefinescolleotedanddepositedpursuanttothissectionshallbegrantedtooommunitybasedorganizationsthatservevictimsofhumantrafficking.Ch)Forpurposesofthischapter,thefollowingdefinitionsapply:3
