Department.CITRUSCOUNTYGOVERNMENTisunderadutytooperateitspolicingactivitiesinalawfulmannersoastopreservetoitscitizenstherights,privileges,andimmunitiesguaranteedtothembytheconstitutionsandlawsoftheUnitedStatesandtheStateofFlorida.3.Uponinformationandbelief,Defendants,SHERIFFJEFFREYJ.DAWSEY,JOHNDOEOFFICERS1-5andJANEDOEOFFICER,areadultcitizensofCitrusCounty,FloridaandarelawenforcementofficerswiththeCitrusCountySheriffsDepartment.TheyaresuedindividuallyandintheirofficialcapacitiesaslawenforcementofficerswiththeCitrusCountySheriffsDepartment.Atthetimeoftheincident,whichisthesubjectmatterofthislitigation,alltheseDefendantswereactingunderthecolorofstatelawandbyvirtueoftheirpositionsaslawenforcementofficers.JURISDICTIONANDVENUE4.ThiscauseofactionarisesoutofanincidentwhichoccurredonoraboutJuly17,2011,onSouthColumbiaStreet,inCitrusCounty,Florida.5.Jurisdictionlieswiththiscourtpursuanttofederalquestionjurisdictionunder28U.S.C.§1331,28U.S.C.§1343,42U.S.C.§1983,42U.S.C.§1988,andtheFourth,NinthandFourteenthAmendmentsoftheConstitutionoftheUnitedStates.PLAINTIFFfurtherinvokesthependentandsupplementaljurisdictionsofthisCourttohearclaimsarisingoutofstatelawpursuantto28U.S.C.

1391.FACTS6.OnoraboutJuly17,2011,atapproximately4:00p.m.,PLAINTIFFwasdrivingonSouthColumbusStreet,inBeverlyHills,Floridawithherchildrenwhowereoneyearoldandfouryearsold.2
 
7.PLAINTIFFapproachedastopsignandcametoacompletestop,afterwhichaCitrusCountySheriffsDepartmentvehicleoperatedbyJOHNDOEOFFICER1stoppedatthesameintersectionandJOHNDOEOFFICER1wavedPLAINTIFFthroughtheintersection.8.AsPLAINTIFFtraveledthroughtheintersection,JOHNDOEOFFICER1suddenlychangedhisdirectionoftraveltopullupbehindPLAINTIFF'Svehicle,afterwhichheflashedhislightsandpulledherover.9.JOHNDOEOFFICER1approachedPLAINTIFF'Svehicle,drewhisweapon,andpointeditatPLAINTIFF.10.JOHNDOEOFFICER1thenorderedPLAINTIFFoutofhervehicle,putherhandsbehindherbackandhandcuffedher.11.WhenPLAINTIFFaskedJOHNDOEOFFICER1whyshehadbeenpulledover,hehadnoresponse.12.PLAINTIFFwasthenplacedinthebackofJOHNDOEOFFICER1'spolicevehicle,whileherchildrenremainedinhercar.13.PLAINTIFFwasdetainedatthesceneforapproximatelytwohours,duringwhichtimeJOHNDOEOFFICERS2,3,4and5andJANEDOEOFFICERarrivedatthescene.14.Duringherdetention,PLAINTIFFwasfriskedandstripsearchedtwiceatthesideofthebusyroad,inplainviewofpassersby.Duringoneofthestripsearches,PLAINTIFFhadatamponforciblyremovedbyJANEDOEOFFICER.15.Atnopointwasadrugsniffingdogusedtosearchforcontraband.16.Noneoftheofficerseverfoundanyweapons,drugs,contrabandoranythingillegalduringPLAINTIFF'sdetention.3
