Description

A lawsuit lead by former Staten Island Borough President Guy Molinari to invalidate a new city law that extends term limits was dismissed by a judge in Brooklyn Federal Court today.

In his 64-page summary judgment, Justice Charles P. Sifton stated that he did not agree with the lawsuit's contention that overturning two public referenda that overwhelmingly supported a limit of two 4-year terms for public officeholders violated the First Amendment, which guarantees the right of political speech and meaningful elections. The law suit also contended that the new city law would have a "chilling effect" on free speech; and that the law violates the Fourteenth Amendment, which "forbids incumbent elected officials from making legislation for the purpose of extending themselves in office."
