Performing Agreement
(Muscial Artist)THIS AGREEMENT
made as of [Date of Agreement (ie. July 1, 2002)] between
[Name of Artist]
(the "Artist") of [Address of Artist] and
[Name of Promoter]
(the "Promoter") of [Address of Promoter].
WHEREAS
:(A)The Promoter is a promoter of artists; and(B)The Promoter wishes to retain the Artist to perform in accordance with the terms andconditions of this Agreement;
NOW THEREFORE
in consideration of the recitals, the mutual covenants hereinafter set forth,and for other good and valuable consideration, the receipt and sufficiency of which is herebyacknowledged, the parties hereto hereby agree as follows:1.The Promoter hereby retains the Artist to perform, and the Artist agrees to perform[Description of Performance (ie. a two hour concert)] (the "Performance") at [DescribeVenue of Performance (ie. the Opera House, Anywhere, State)] (the "Venue") on [Date of Performance].2.The Promoter agrees to furnish the Venue at its own expense on the date at the timementioned for the Performance, well-heated, lighted, clean, in good order, and with allnecessary tickets, special police, ushers, ticket sellers (whether the sales take place at theVenue or elsewhere), ticket-takers, bill-posting, mailing, and distribution of circulars,daily display and advertising in the principal newspapers, licence (if required), cleandressing rooms near the stage for the Artist, and accompanist if any, and all necessaryservices connected with the foregoing. No seats are to be permitted on the stage withoutthe prior written consent of the Artist.3.All musical instruments and equipment required for the performance shall be provided bythe Promoter at its own expense, with the exception of the musical instruments andequipment specified in Schedule "A" hereto.4.The Artist agrees to furnish a copy of the program to be performed during thePerformance which is to be printed in conformity with material furnished by the Artist,and distributed in sufficient quantity by the Promoter at its expense.5.The Promoter agrees to use reasonable commercial efforts to publicize the Performancein order to maximize attendance at the Performance. The Artist will, as a courtesy but notas an obligation, furnish such quantity of cuts, press material, circulars, window cards or posters as the Artist in its sole discretion considers necessary or desirable. The Promoter agrees to properly distribute and display all advertising material it receives, and to payshipping, express charges or both on material furnished by the Artist.
