Ihavethirty-five(35)yearsofexperienceworkinginlawenforcement.Ihaveanadditionaleleven(11)yearsoflawenforcementrelatedexperience.IhaveservedinnumerousassignmentsfromPoliceOfficertoPoliceChiefinboththePhoenix,ArizonaandDallas,TexasPoliceDepartments.WhileservingastheDallasPoliceChief,IalsoservedastheAssistantCityManagerforPublicSafetyfromAugust1998toFebruary1999.Ihavebeeninvolvedinapproximatelyfivethousand(5,000) internalinvestigationsthatexaminedpoliceemployees'conductandperformance.Ihaveinterviewedandtrainedhundredsofpoliceofficers,supervisorsandcommandpersonnel.Ihaveparticipatedintheresearch,developmentandimplementationofpolicies,proceduresandtraininggoverninghowpoliceofficersperformtheirjobs.Ihavebeeninvolvedintakingdisciplinaryandcorrectiveactionsinthoseincidentswhereitwasdeterminedthedepartments'policiesandprocedureswereviolated.Thereisabodyofknowledgeregardinglawenforcementpracticesandstandardsthathasevolvedintheinterestsoffosteringprofessionalismandeffectiveness.ThroughtheprofessionalassociationstowhichIbelong,mydiscussionswithcolleagues,mytrainingandpersonalexperiences,Iamfamiliarwiththegenerallyacceptedpolicies,proceduresandtrainingthatgoverntheperformanceandconductoflawenforcementofficers.

DuringthenextseveralhoursMr.Huminskirespondedtothee-mailbyleavingseveralvoicemailsforOfficerHeredia.Inthevoicemails,Mr.HuminskiaccusesOfficerHerediaofinterferingwithcivillitigationandHuminskiindicatedhewouldpursuecriminalcharges.Mr.HuminskidemandedthattheordertonothavecontactwithMr. NelsonandhisattorneyberescindedimmediatelyorhewillfilealawsuitagainstthePoliceDepartment.Mr.HuminskilefthistelephonenumberandOfficerHerediawasabletomaketelephonecontactwithMr.HuminskilaterintheafternoonofApril13,2011(Recordedvoicemailmessages).DuringOfficerHeredia'stelephoneconversationwithMr.HuminskionApril13,2011, Mr.HuminskiaccusedOfficerHerediaofobstructionofjustice,ofviolatingstateandfederallaw,ofthreateninghimandconspiringtoevadestateandfederaltaxlaws.Mr.HuminskialsostatedthathehasbeenharassedandthreatenedbyMr.Nelson.OfficerHerediainformedMr.Huminskithathewantedtobefairtohimbygettinghissideofthestoryforthepolicereport.OfficerHerediatoldMr.HuminskithatallhecoulddowasrequestthatMr.HuminskihavenocontactwithMr.NelsonandNelson'sattorney.OfficerHerediainformedMr.HuminskithathecouldnotorderhimorpreventhimfromcontactingthemanditwashischoicewhetherornottocontactMr.Nelsonandhisattorney.
