DuringthenextseveralhoursMr.Huminskirespondedtothee-mailbyleavingseveralvoicemailsforOfficerHeredia.Inthevoicemails,Mr.HuminskiaccusesOfficerHerediaofinterferingwithcivillitigationandHuminskiindicatedhewouldpursuecriminalcharges.Mr.HuminskidemandedthattheordertonothavecontactwithMr.
NelsonandhisattorneyberescindedimmediatelyorhewillfilealawsuitagainstthePoliceDepartment.Mr.HuminskilefthistelephonenumberandOfficerHerediawasabletomaketelephonecontactwithMr.HuminskilaterintheafternoonofApril13,2011(Recordedvoicemailmessages).DuringOfficerHeredia'stelephoneconversationwithMr.HuminskionApril13,2011,
Mr.HuminskiaccusedOfficerHerediaofobstructionofjustice,ofviolatingstateandfederallaw,ofthreateninghimandconspiringtoevadestateandfederaltaxlaws.Mr.HuminskialsostatedthathehasbeenharassedandthreatenedbyMr.Nelson.OfficerHerediainformedMr.Huminskithathewantedtobefairtohimbygettinghissideofthestoryforthepolicereport.OfficerHerediatoldMr.HuminskithatallhecoulddowasrequestthatMr.HuminskihavenocontactwithMr.NelsonandNelson'sattorney.OfficerHerediainformedMr.HuminskithathecouldnotorderhimorpreventhimfromcontactingthemanditwashischoicewhetherornottocontactMr.Nelsonandhisattorney.

Thenextday,April14,2011,Mr.HuminskifiledsuitagainsttheCityofSurprise,OfficerHerediaandtwootherCityemployeesintheMaricopaCountyHighlandJusticeCourtinGilbert.Mr.Huminskiclaimedthathehadsuffereddamagesduetothedefendants'disregardforhisrights,harassment,negligenceandthedefendants'coercivemanipulationofacivilcourtmatter.Heaskedthecourttoawardhim

OnApril14,2011,OfficerHerediasentane-mailtoMr.Huminski.OfficerHerediaaskedMr.Huminskitocomeintothestationforidentificationpurposesbecauseitisnotpossibletoconfirmaperson'sidentitythroughphonecallsande-mails.OfficerHerediatoldMr.HuminskihehaduntilApril16,2011tocomeinandgivehissideofthestoryandifhedidnot,thereportwouldbeforwardedtotheprosecutor'sofficeonlycontainingtheinformationprovidedbyMr.Nelson
