Introduction of the General Authority for State Registration of Mongolia

The General Authority for State Registration of Mongolia With an aim to establish an aggregate system of registration and information in Mongolia, to improve a quality of public services and peoples accessibility to these services and to enhance coordination and correlation among government organizations, the National Program to establish an aggregate system of registration and information in Mongolia was approved by the government decree No.78 in 2008.

The General Authority for State Registration of Mongolia

In the framework of this progam, the government

has established the General Authority for State Registration as an implementing agency within the portfolio of the First Deputy Prime Minister of Mongolia by integrating Civil registration and information agency, Property registration authority and State registration authority of National General Taxation authority in April, 2009.

In order to congure a legal environment for an

aggregate system of state registration and to coordinate the relations aliated to this sysrem in Mongolia, the General Law on State Registration was enacted by the Parliament on June 25th , 2009 .

 THE FOLLOWING TYPES OF SERVICES ARE PROVIDED BY GASR IN TERMS OF CIVIL REGISTRATION: birth registration; marital status; dissolution of marriage; marriage restoration; determination of parenthood; adoption; surname and name changes; death registration; civil identication; travel documents; civil permanent residence; movement; registration of citizenship obtaining, change and restoration.

Renewed Civil Registration of Mongolia (2)

The program implementation reached 97.8 per cent as

of today. Renewed registration also taking a process in 35 Embassies of Mongolia in Foreign countries.

 THE FOLLOWING TYPES OF SERVICES ARE PROVIDED BY GASR IN TERMS OF TITLE REGISTRATION:

property possession right; property ownership right; right for property usage; pledge; guarantee; lease; servitude; usufruct; right to build premises on others land; registration of a contract right for leasing.

 The Legal Entity Registration

In order to form the new registration system of legal

entity, the Law on Legal entity registration was approved in 1991.

 THE FOLLOWING TYPES OF REGISTRATIONS ARE PROVIDED BY GASR IN TERMS OF LEGAL ENTITY (1):

State Registration of foreign invested legal entity in Mongolia

STATE REGISTRATION OF FOREIGN INVESTED LEGAL ENTITY IN MONGOLIA

Every legal entity that is going to carry out activities in

Mongolia should be registered at the General Authority for State Registration of Mongolia /GASR/.

Foreign investment protected by the law. Foreign invested companies should be registered at the

General Authority for State Registration of Mongolia.

 STATE REGISTRATION OF FOREIGN INVESTED LEGAL ENTITY IN MONGOLIA

There are 6 types of foreign investment in Mongolia

REGISTRATION PROCESS OF FOREIGN INVESTED LEGAL ENTITY IN MONGOLIA

First of all, foreign investors should go to the Foreign Investment and Foreign Trade Agency /FIFTA/ with required documents and apply for the certicate of FIFTA and get investors card.

STATE REGISTRATION PROCESS OF A LEGAL ENTITY IN MONGOLIA

After the permission investors should go to the General Authority for State Registration of Mongolia to register their legal entity.

In order to register a company an applicant have to submit the following materials to the State registration oce : (at GASR)
Application Letter to the State Registration of Legal Entity Decision from the head department about the establishment Laws and Regulations of Legal Entity Contract of forming the Legal Entity Decision from the Foreign Investment and Foreign Trade agency on

forming Foreign Invested Entity Certicate of establishing Foreign Invested Entity CV of founders of the legal entity, copies of Citizens ID or equivalent documents of the legal entitys founders

Registration complete - Ready for activity

After the registration at GASR, the Legal entity is

assumed as legalized to perform its operations and the rights of the legal entity are armed.

 MAIN MEASURES TO IMPLEMENT IN THE FUTURE

With an aim to implement the National Program to establish an aggregate system of registration and information in Mongolia the following measures would be done in near future: Develop project on Legal entity registration law Build basements for digital reference and information Implement Digital archive project of State registration and information Build legislation environment for use of digital signature Issue digital National ID cards.
