DREEBENON BEHALF OF THE PETITIONERMR. DREEBEN: Mr. Chief Justice, and may itplease the Court:The postal inspectors in this case appliedfor a warrant to search respondent's property. Thewarrant that they obtained particularly described theplace to be searched and the things to be seized. Itwas issued based on an affidavit that informed themagistrate judge that a videotape containing childpornography that respondent had ordered through themail and had paid for in cash was going to be deliveredto respondent's house and that the warrant would not beexecuted until the delivery had taken place.The Ninth Circuit held that the execution ofthis warrant, which occurred after the delivery thatthe postal inspectors represented would occur had infact happened, violated the Particularity Clause of theFourth Amendment.The Ninth Circuit's opinion is wrong because
