FRANKLIN: Justice Stevens, and may itplease the Court:The patent claim at issue in this case washeld to be infringed whenever any doctor looks at ahomocysteine test result and reflexively thinks about abasic natural correlation. The result has been multimilliondollar damages and an injunction prohibiting a testingcompany from conducting important homocysteine tests by anymethod and for any reason whatsoever.As broadly construed by the Federal Circuit,this claim is invalid as a matter of law for two closelyrelated reasons. It contravenes both of this Court'ssettled proscription against effectively patenting laws ofnature or natural phenomena as well as the requirement thata patent must fully and clearly describe, disclose andenable an actual invention and must not sweep so far as to
