On this date at about 1029 hours, myself and Officer Ralph Smith were dispatched to that area of 14th and
Spruce on a tone alert. The call was a white male who had threatened another male with a knife and the suspect
was still in the area. The original description of the suspect was a white male wearing a black shirt, blue jeans,
blonde hair, carrying a backpack, on a bicycle. We were also told that the suspect had put the knife back inside
his right side pants pocket and had entered an unknown business on Spruce between 13th and 14th.
Traffic Sergeant Michael Everett arrived in the area first and spoke to the victim, Jason Thieme and a witness
Cassidy Gebhardt. As I arrived in the 1300 block of Spruce(at about 1033 hours), Sergeant Everett informed me
that the suspect had entered the methadone clinic located at 1317 Spruce. I spoke briefly with the
witness,Gebhardt, and he told me that the suspect(later identified as Taylor Rose) was the only person inside the
clinic and that he had blonde 'spiky' hair. Gebhardt told me that he had not seen 'the knife' but he did see Rose
swerving into traffic while riding his bike.
Just as I finished speaking with Gebhardt, the door to 1317 Spruce opened and a male matching that description
exited. I could hear Gebhardt behind me saying "that's him". I was in full police uniform, identified myself and I
ordered Rose to stop where he was. I immediately smelled a strong odor of alcohol on his person. Rose put his
hands up about shoulder high, but then lowered his right hand to his right rear pocket. Believing that he might be
reaching for his knife, I pointed my firearm at him and ordered him to keep his hands up. Rose had a confused
look in his face and repeatedly kept saying "what did I do". As he slowly complied with my commands, I told him
he was being detained for felony menacing. Rose would say in a moderately slurred voice: "what did I do" and "If
I have a knife its in my pocket".
For safety reasons, Officer Diamond placed handcuffs on Rose. I then heard Sergeant Everett say that we had a
positive identification, and we had criminal charges. At about 1035 hours, I informed Rose that he was under
arrest for felony menacing and he kept asking what that meant. I told Rose that a victim and witness had told us
that he had pointed a knife at the victim. I then searched Rose incidental to arrest locating a silver folding style

knife in his right front pants pocket. I seized the knife and placed it into my right side cargo pocket until such time
that I could return to the police department and place it into an evidence locker. I told Rose several times why he
was under arrest because he kept asking what he had done. I noticed his eyes were bloodshot and I asked if he
had consumed any alcohol or drugs. Rose told me several times he had not been drinking and that he had not
pointed his knife at anyone. Rose also asked why we were believing only one person. I tried to explain to Rose
that there was also a witness to the incident, and Rose replied: "I didn't drink, I did drink last night." As we
escorted Rose to my patrol vehicle, I told him I could smell the odor of alcohol on his breath and person. Rose
replied: 'I don't drink, I didn't do anything, what did I do." Rose also was concerned about his brown bicycle not
being secured. Rose asked several times that we let go of him and go get his bicycle. The employee's of the
clinic informed us that they would secure Rose' bicycle inside the clinic until such time that he returns to claim it.
Rose was placed into the caged area of my patrol vehicle and just as I started to ask him if he would perform a
voluntary roadside maneuver (HGN) he told me: "call my lawyer and speak to him". I interpreted this as an
invocation of his Miranda rights so I informed him that I would not be asking him any questions about the crimes
but I would need to ask pre-booking questions. Rose did provide me with the booking information(place of birth,
medical conditions, etc) and he did confirm that he had entered the clinic to ingest his dose of methadone.
I spoke briefly with the victim, Thieme, who was standing next to his red truck. I could see that he was still
shaking slightly. Thieme was completing a voluntary written statement and I asked him to tell me what had
happened. Thieme told me the following:
He was driving his truck westbound in about the 1600 block of Spruce, and Rose was riding his bicycle the same
direction but on the right side of the roadway. Thieme stated that Rose swerved in front of his truck and he had to
swerve to avoid striking Rose. Rose swerved several times into the path of Thieme's vehicle. They both reached
a stop sign on Spruce at 15th with Rose on the passenger side of his truck. Thieme yelled "what the fucks wrong
with you" and Rose yelled back 'what the fucks wrong with you'. Rose then got off his bicycle and leaned into
Thieme's passenger window. Thieme could smell a strong odor of alcohol coming from Rose. Rose then walked
around the front of Thieme's truck to the drivers side window. Rose stuck his face close to Thieme and yelled at
him. Rose then stepped back slightly, pulled a knife out of his pant pocket, opened the blade and waved the knife
at Thiemes face. Thieme was afraid Rose was going to stab him and he felt trapped inside his truck so he tried to
open his door to move away from Rose. While doing this, Thieme yelled at Rose that he was calling the police.
Rose got back on his bicycle and started to ride it westbound down Spruce to about a half block away where he
stopped.
Thieme confirmed that he did want to pursue charges against Rose because he firmly believed that Rose was
going to try and stab him with the knife. Thieme will contact the department when he has completed his written
statement.
I returned to my vehicle and Sergeant Dave Seper handed me a written voluntary statement from the witness,
Gebhardt. I read that statement and learned the following: Gebhardt was driving behind a red Toyota Tacoma
(Thiemes vehicle) at the corner of Spruce and 15th. Gebhardt saw Rose riding his bicycle the same direction and
Rose repeatedly swerved into traffic causing Thieme to have to swerve to avoid Rose. As both Thieme and Rose
reached the stop sign, Rose jumped off his bike and entered the truck through the passenger window. Rose then
circled the truck and attempted to enter the truck through the drivers window. As Gebhardt drove past them, he
saw a physical exchange between Rose and Thieme.
Officer Ralph Smith took control over Rose' backpack and searched it incidental to arrest. Officer Smith located a
plastic container of (what based on both of our training and experience) was marijuana. Officer Smith took the
backpack to the Boulder Police Department and weighed the marijuana finding it to be 3.3 grams. Officer Smith
secured the property until I could return and place it into property and evidence.
I transported Rose to the Boulder County jail and during the trip the odor of alcohol coming from Rose was very
strong. The only conversation we had was when Rose would ask several times what was going on, and I would
tell him again he was going to jail for felony menacing. Rose also asked me to call his mother for him, and what
would his bond be set at. For most of the drive to the jail, Rose repeatedly stated that he had not done anything.
Rose was lodged at the jail for felony menacing and driving under the influence. The written voluntary statement
