 Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Attracting the Best

and the Brightest Act of 2012’’.

(a) A

RADUATES
.—Section 203(b)
3
of the Immigration and Nationality Act (8 U.S.C.
4
1153(b)) is amended—
5
(1) by redesignating paragraph (6) as para-
6
graph (7); and
7
(2) by inserting after paragraph (5) the fol-
8
lowing:

‘‘(6) A 
DVANCED GRADUATES IN SCIENCE
,

TECHNOLOGY 
,
ENGINEERING AND MATHEMATICS
.—

‘‘(A) I
N GENERAL
.—Notwithstanding sec-
12
tion 201, visas shall be made available, in a
13
number not to exceed 50,000, to qualified im-
14
migrants who—
15
‘‘(i) possess a graduate degree at the
16
level of master’s or higher in a field of 
17
science, technology, engineering, or mathe-
18
matics from a United States research insti-
19
tution of higher education;
20
‘‘(ii) have an offer of employment
21
from a United States employer in a field
22
related to such degree;
23
‘‘(iii) are the subject of an approved
24
labor certification as required under sec-
25
tion 212(a)(5)(A); and

3‘‘(iv) will receive a wage level from the

employer that is at least the actual wage
2
level paid by the employer to all other indi-
3
 viduals with similar experience and quali-
4
fications for the specific employment in
5
question.

‘‘(B) D
EFINITIONS
.—For purposes of this
7
paragraph:
8
‘‘(i) The term ‘field of science, tech-
9
nology, engineering, or mathematics’
10
means a field included in the Department
11
of Education’s Classification of Instruc-
12
tional Programs taxonomy within the sum-
13
mary groups of computer and information
14
sciences and support services, engineering,
15
mathematics and statistics, and physical
16
sciences.
17
‘‘(ii) The term ‘United States research
18
institution of higher education’ means an
19
institution in the United States that—
20
‘‘(I) is described in section
21
101(a) of the Higher Education Act
22
of 1965 (20 U.S.C. 1001(a));
23
‘‘(II) is classified by the Director
24
of the National Science Foundation as
