, No.12-3644 Notice of Denial of Administrative Stay and Intention to Seek Emergency StayDear Ms. Wolfe:The federal government filed a notice of appeal yesterday in the above-captionedcase brought by a group of journalists and public advocates, where the district court hadentered a permanent injunction on Wednesday barring the President from enforcingdetention authority set forth in § 1021(b)(2) of the National Defense Authorization Act.Order at 111-12. The injunction squarely implicates the government’s war powers in anongoing armed conflict overseas. In issuing the injunction, the district court stated that, if a contempt action were brought before the court that challenged the government’sdetention authority, the government would “bear a heavy burden indeed.” Order at 14.The government filed a motion today in the district court for a stay pendingappeal and for an immediate interim stay pending resolution of the stay request to allowthe court time to consider the motion. That motion is attached. Late this afternoon, thedistrict court denied that request for an immediate stay in the attached order.
