The building unveiled today as the Victor Martinez Community Library was part of a Carnegie Foundation endowment of four libraries given to the city of Oakland between 1916 and 1918. Oakland's librarian at the time, Charles S. Greene, believed that the city's people would benefit most from libraries placed within their communities. Despite this vision, the building was one of seven branch casualties of budget cuts in the late seventies, severing vital library life-lines in poor and working communities. Since then, the "Latin American Branch" library building located at the corner of Miller and 15th st. has mostly sat empty, despite the fact that the next nearest library is miles away, and increasingly difficult to access in a city like Oakland with an increasingly expensive transit system. With its eroding chain link fence and decaying, armored exterior, the building is much more than an eyesore; the unused, but inaccessible, space creates a life-draining dark vacuum of stability that serves at best as a convenient place for the unscrupulous to dump their old mattresses, couches and assorted garbage. This morning, a group of activists opened this building again for use as a library. Inside is the modest seed for a library and community center-hundreds of books donated by people who envision the rebirth of local, community-owned libraries and social and political centers throughout Oakland. We've named the building after recently deceased author, Victor Martinez, who overcame a young life of hard agricultural work to become a successful writer in the Bay Area. His semi-autobiographical novel, Parrot in the Oven, has become a seminal work of the Latino experience. Martinez died last year at 56 of an illness caused by his work in the fields.

If you live in this community, we only ask that you think about how you can use this building. Name it anything you like. Purpose it to any goal that benefits the community-library, social or political neighborhood center. All we ask is that you consider keeping it out of the hands of a city which will only seal the fence and doors again, turning the space back into an aggregator of the city's trash and a dark hole in the middle of an embattled community. The doors here are open. And there are many others simply waiting to be. OAKLAND -- If you want to catch up on your summer reading but don't have a library card, volunteers at Oakland's newest (unofficial) library branch will be happy to help. No paperwork, no due date. As an organizer posted on Twitter, "Your soul is your library card at #peopleslibrary." After all, it's anyone's guess how long the renegade operation will stay open. About 7 a.m. Monday, activists took over a vacant building in East Oakland's San Antonio neighborhood, which they said had been left unlocked. After word spread on Facebook, about a dozen volunteers arrived and set to work, stocking it with donated books and clearing out grime, old mattresses, graffiti and other markings of abandonment. A bilingual banner hanging in front of the entrance at 1449 Miller Ave. welcomed passers-by to the "Victor Martinez People's Library," named for the late Latino author. Decades ago, the building housed an official city library, an ornate space with built-in wooden bookshelves and high ceilings decorated with molding. Completed in 1918, it was one of four branches funded with a Carnegie grant. But that branch closed in the 1970s, and since then, the building has sat mostly unused, said Jaime Silva, one of the organizers. Squatters and illegal dumping have turned the property into an eyesore, he said. "I think everyone in the community is psyched this will no longer be a dumping ground," said Silva, 43. The building is owned by the city of Oakland's Redevelopment Successor Agency within the Office of Neighborhood Investment. In an email Monday, an agency spokesman said the city would issue a dispersal order with a set time to vacate the property; his response didn't include the city's plans for the blighted building, which remains in disrepair. Late Monday morning, people began trickling in. Some checked out books, shared their ideas, or asked how they could help. "You open Monday through Friday?" one man asked a volunteer. "We have no idea," the volunteer responded. Goldie Simmons, of San Leandro, whose husband is the pastor of the nearby Agnes Memorial Church, said she and her husband had proposed that city officials turn the building into a youth center, but that they were told it needed to be retrofitted. She said she was glad people had taken matters into their own hands. "There's nothing in this area, really," she said. "There's really no place for kids to come."

Silva and other activists say the goal is for the building to be used for a community purpose, whether it's a library or a community center with a garden. "All we ask is that you consider keeping it out of the hands of a city which will only seal the fence and doors again, turning the space back into an aggregator of the city's trash and a dark hole in the middle of the community," according to the group's news release, aimed at residents of the surrounding neighborhoods. Organizers planned an event for Monday evening -- a 6 p.m. potluck dinner, followed by a poetry reading. They said they didn't know how they planned to maintain a presence at the building, or whether anyone would spend the night there. The Rev. Robert Holt, pastor of the First New Jerusalem Mission Baptist Church on 24th Avenue and Foothill Boulevard, said he hoped the effort would evolve into something lasting and fruitful, rather than a brief act of protest. "If they're going to do it, I'd like to see it be done right," Holt said. "This area needs something that's going to impact the community, that's going to change lives, that's going to uplift the people -especially the youth," he said.

Hello Office Watson, Harry Hamilton said you'd be expecting my email in regards to the police action which vacated the occupants of 1449 Miller Ave. back on Monday, 8/13. Mr. Hamilton said you'd be able to provide a time line of events for the day, as well as the process in which the decision was made to vacate that property. I'd love any information you can share with me with regards to why the police took steps to vacate the building. Additionally, many local residents seem frustrated with your department's response to the occupancy: some have said the department doesn't respond when residents call for help, and yet it cleared out a space community members saw as a positive move for the neighborhood. OAKLAND -- Police ordered activists Monday night to leave the "people's library" they'd installed in a vacant city building, an officer said. Ten to 15 people left the property at 1449 Miller Ave., near International Boulevard, shortly after officers entered the building at about 11 p.m. and told the activists they were trespassing, police spokeswoman Officer Johnna Watson said. The group had been occupying the building since about 7 a.m. Monday. The activists took over the vacant building in Oakland's San Antonio neighborhood, which they said had been left unlocked. After word spread on Facebook, about a dozen volunteers arrived and set to work, stocking it with donated books and clearing out grime, old mattresses, graffiti and other markings of abandonment. They put up a bilingual banner proclaiming the "Victor Martinez People's Library," named for the late Latino author. When officers arrived at the scene Monday night, they ordered the occupants to leave, and they did so, taking their books and other property with them, Watson said. The activists were cooperative and peaceful, she added, and there were no injuries or arrests. Public works employees boarded up the building, she said. Officers were stationed at the property overnight to ensure nobody broke back in, Watson said. The building had been a city library until 1979, Watson said. After the library closed, the building housed a continuation school and then a social services center. It was closed in 2010, Watson said. When it was built the building was an ornate space with built-in wooden bookshelves and high ceilings decorated with molding. Mayor Quan, This morning a wonderful thing happened. A building which has sat unused and unwanted in this city was transformed into a public space, a library. No one asked for money. People came together, neighborhood kids donated books. And now it's being raided by the police. Arrests will be made. The books are being taken away. STOLEN. I'm disgusted to live in a city where a building can sit vacant for forty years, gathering trash, being used for nothing except as a crackhouse and a firehazard, but the minute that building is put to use for the public good the police are used to force occupants out and steal community property. I voted for you. I will never vote for you again. I will campaign against you in every way I can in any election you ever choose to run in. I will extend this to anyone you support or who has supported you, because these actions are happening under your tenure and your supervision. Oakland deserves better than this. The property at 1449 Miller Avenue was owned by the Oakland Redevelopment Agency and is now owned by the Redevelopment Successor Agency housed within the Office of Neighborhood Investment. Once the City of Oakland became aware that the building had been occupied on Monday, August 20, the City notified the occupants that they were trespassing and that they needed to vacate the premises. The occupants complied with the request to vacate the premises late that evening. The building's current condition does not meet safety and seismic codes. With the very limited resources available to the City following the elimination of the Oakland Redevelopment Agency (ORA), rehabilitation of the building would probably require significant private sector investment. Over the next several months, the Successor Agency will be developing a disposition strategy regarding real estate assets in its portfolio, including 1449 Miller Avenue. This strategy will detail the agency's plans for the buildings. The strategy will be reviewed and approved by the Oversight Board and the California Department of Finance as required by State legislation. Public comment can be made at the Oversight Board meeting. The City of Oakland is open to discussions with any qualified community organization or developer interested in pursuing use of this City Landmark building which is also listed on the National Register of Historic Places .

The building unveiled today as the Victor Martinez Community Library was part of a Carnegie Foundation endowment of four libraries given to the city of Oakland between 1916 and 1918. Oakland's librarian at the time, Charles S. Greene, believed that the city's people would benefit most from libraries placed within their communities. Despite this vision, the building was one of seven branch casualties of budget cuts in the late seventies, severing vital library life-lines in poor and working communities. Since then, the "Latin American Branch" library building located at the corner of Miller and 15th st. has mostly sat empty, despite the fact that the next nearest library is miles away, and increasingly difficult to access in a city like Oakland with an increasingly expensive transit system. With its eroding chain link fence and decaying, armored exterior, the building is much more than an eyesore; the unused, but inaccessible, space creates a life-draining dark vacuum of stability that serves at best as a convenient place for the unscrupulous to dump their old mattresses, couches and assorted garbage. This morning, a group of activists opened this building again for use as a library. Inside is the modest seed for a library and community center-hundreds of books donated by people who envision the rebirth of local, community-owned libraries and social and political centers throughout Oakland. We've named the building after recently deceased author, Victor Martinez, who overcame a young life of hard agricultural work to become a successful writer in the Bay Area. His semi-autobiographical novel, Parrot in the Oven, has become a seminal work of the Latino experience. Martinez died last year at 56 of an illness caused by his work in the fields.

If you live in this community, we only ask that you think about how you can use this building. Name it anything you like. Purpose it to any goal that benefits the community-library, social or political neighborhood center. All we ask is that you consider keeping it out of the hands of a city which will only seal the fence and doors again, turning the space back into an aggregator of the city's trash and a dark hole in the middle of an embattled community. OAKLAND -- Activists took over an abandoned library branch Monday morning in East Oakland, where they said squatters and illegal dumping have turned the property into a useless eyesore. The former city library, at 1449 Miller Ave., was abandoned in the '70s and has sat mostly unused, said Jaime Silva, one of 10 people at the site Monday. They were cleaning up with mop buckets and stocking empty shelves with books. "I think everyone in the community is psyched this will no longer be a dumping ground," said Silva, 43, who is a translator. A few people had already stopped by to check out books, he said. A banner was hung in front of the entrance, dubbing the site "Victor Martinez People's Library," named for the late Latino author. Silva didn't say how the group gained access to the site Monday, only saying that they were told it was unlocked and arrived there at 7 a.m. It wasn't immediately known whether the city owns the property or another agency. The goal is for the building to be used for a community purpose, such as a library or community center, said Silva. An area in the back could be used for a garden, he said. "All we ask is that you consider keeping it out of the hands of a city which will only seal the fence and doors again, turning the space back into an aggregator of the city's trash and a dark hole in the middle of the community," according to the group's news release, aimed at residents of the surrounding Fruitvale and the 23rd Avenue commercial district neighborhoods. The building was completed in 1918, one of four library branches funded with a Carnegie grant.

OK, here's the long version I started earlier: Hi, HamidAs we discussed yesterday with Joann, both the Miller Library and the Montclair Fire Station are designated City Landmarks. In addition, the library is on the National Register of Historic Places as part of a statewide thematic designation of Carnegie libraries. There are only about 150 City Landmarks, and designation is by Council ordinance, so it is pretty clearly City policy that these are among Oakland's select major tip-top significant buildings that are to be recognized and preserved. Landmarks are part of Oakland's Local Register of Historical Resources, and are protected under CEQA as provided in the City's CEQA Thresholds of Significance, the Preservation Element of the Oakland General Plan, the Landmarks Board's adopted findings for demolition or major alteration, the Design Review process, etc. etc. Obviously it is "possible to demolish" anything, but the process would not be quick, easy, cheap, or a generator of 2

goodwill (an EIR would likely be involved as the nuclear deterrent). The fact that a landmark "needs major repairs" is not a justification for demolition, especially if the deterioration came about through neglect. Landmark designation is recorded with the County. Any buyer would need to know that these parcels are not blank slates. There are a number of programs designed to facilitate reuse and rehabilitation of historic buildings. For a building on the National Register (Miller Library) there is a 20% federal rehabilitation investment tax credit. The building has to be in income-producing use and the rehab work has to be substantial (cost over 2 years equals or exceeds adjusted basis in the building) and certified (intensely documented before-and-after and reviewed by the National Park Service: www.nps.gov ). For pre-1936 buildings in commercial use and not currently on the National Register (the Montclair firehouse), there is a 10% rehab credit that is much easier to get - it has to be substantial as for the 20%, but does not need any special federal review (IRS form 3468). The City has a Mills Act program (www.oaklandnet.com/historicpreservation) which can provide a property tax reduction if the owner enters into a contract with the City to put the tax savings back into rehabbing the building according to a Landmarks Board-approved work program. Both these properties are pre-qualified since they are already landmarks; other owners have to get their properties designated as a prerequisite. Both are also pre-qualified to use State Historical Building Code which allows many problems such as access and egress and seismic retrofit and fire protection to be solved on the building's own terms, which can save time and money and protect historic features. As designated landmarks, design review fees are waived for these properties. Design review would potentially be expedited since it would go straight to landmarks staff rather than waiting around for a planner. The building unveiled today as the Victor Martinez Community Library was part of a Carnegie Foundation endowment of four libraries given to the city of Oakland between 1916 and 1918. Oakland's librarian at the time, Charles S. Greene, believed that the city's people would benefit most from libraries placed within their communities. Despite this vision, the building was one of seven branch casualties of budget cuts in the late seventies, severing vital library life-lines in poor and working communities. Since then, the "Latin American Branch" library building located at the corner of Miller and 15th st. has mostly sat empty, despite the fact that the next nearest library is miles away, and increasingly difficult to access in a city like Oakland with an increasingly expensive transit system. With its eroding chain link fence and decaying, armored exterior, the building is much more than an eyesore; the unused, but inaccessible, space creates a life-draining dark vacuum of stability that serves at best as a convenient place for the unscrupulous to dump their old mattresses, couches and assorted garbage. This morning, a group of activists opened this building again for use as a library. Inside is the modest seed for a library and community center-hundreds of books donated by people who envision the rebirth of local, community-owned libraries and social and political centers throughout Oakland. We've named the building after recently deceased author, Victor Martinez, who overcame a young life

of hard agricultural work to become a successful writer in the Bay Area. His semi-autobiographical novel, Parrot in the Oven, has become a seminal work of the Latino experience. Martinez died last year at 56 of an illness caused by his work in the fields. If you live in this community, we only ask that you think about how you can use this building. Name it anything you like. Purpose it to any goal that benefits the community-library, social or political neighborhood center. All we ask is that you consider keeping it out of the hands of a city which will only seal the fence and doors again, turning the space back into an aggregator of the city's trash and a dark hole in the middle of an embattled community. The doors here are open. And there are many others simply waiting to be. Update: Occupy Oakland announces a community potluck at 6pm local time and poetry/spoken word reading at tpm at the Library tonight!

The City of Oakland has become aware that the building at 1449 Miller Avenue has been occupied unlawfully.

The property was owned by the Oakland Redevelopment Agency and is now owned by the Redevelopment Successor Agency housed within the Office of Neighborhood Investment.

As the property owner, the City of Oakland will notify the occupants that they are trespassing and that they need to vacate the premises. The City and Oakland Police Department will provide them a set time to vacate or face removal.

"I think everyone in the community is psyched this will no longer be a dumping ground," said Silva, 43, who is a translator. A few people had already stopped by to check out books, he said. A banner was hung in front ofthe entrance, dubbing the site "Victor Martinez People's Library," named for the late Latino author. Silva didn't say how the group gained access to the site Monday, only saying that they were told it was unlocked and arrived there at 7 a.m. It wasn't immediately known whether the city owns the property or another agency. The goal is for the building to be used for a community purpose, such as a library or community center, said Silva. An area in the back could be used for a garden, he said. "All we ask is that you consider keeping it out of the hands of a city which will only seal the fence and doors again, turning the space back into an aggregator of the city's trash and a dark hole in the middle of the community," according to the group's news release, aimed at residents of the surrounding Fruitvale and the 23rd Avenue commercial district neighborhoods.
