District Court Judge John Ward has called on the Attorney Generals office to assist the Department of Education in having mandated laws on the displays of affection as far as governing the behavior of teachers towards their students. These remarks were rendered by Judge Ward while he was handing down sentencing for Manumalo Teacher Dave Tupua yesterday morning in the District Court. The science teacher accused of inappropriately touching a female student was initially charged with false imprisonment and two charges of third degree assault for offensive touching, however in a plea deal with the government, the teacher pleaded guilty to third degree assault, a class C misdemeanor. Tupua told the court his actions were just friendly gestures that he shows to all his students, which he deeply regrets. He apologized to the family of the victim and the student for what occurred.

Public Defender Ruth Risch-Fuatagavi describes the local death penalty statute as unconstitutional because its cruel and unusual punishment and she strongly supports repealing the statute, which is being proposed by Gov. Togiola Tulafono. With such a small island community, its difficult to find a fair and impartial jury to hear such a case, if prosecutors move to impose capital punishment, which will be very costly to defend, she said. Risch-Fuatagavi, along with Attorney General Fepuleai A. Ripley Jr., Deputy Attorney General for criminal division Mitzie Jessop and American Samoa Bar Association president Marcellus Talaimalo Uiagalelei testified yesterday before the House Legal Affairs Committee on the bill to repeal the death penalty, which has been in the law book for years.
Uiagalelei, who is also in private practice, was the first to testify, telling the committee that he only received the summons on Monday, while this particular issue has not been discussed by the association and its members, and therefore he could not testify as president of the bar. Vice Speaker Faafetai Iaulualo requested for the committees record, an official written statement from ASBA on this matter to assist the House in making their final decision on the proposal. Uiagalelei was given the chance to testify as a local attorney and a resident of the territory and he told the committee that he believes a change to the law is long overdue, pointing out that American Samoa is a Christian nation. He recalled during his time as an assistant attorney general several years ago when the Attorney Generals Office discussed the death penalty in the case against Richard Majhor , who was convicted by a six-member jury in early 2006

On Oct. 13, 1775, the Continental Congress authorizes construction and administration of the first American naval force. Esek Hopkins was appointed the first commander-in-chief of the Continental Navy. His first fleet consisted of seven ships: two 24-gun frigates, two 14-gun brigs and three schooners. On Oct. 12, 1786, a lovesick Thomas Jefferson composes the first of many romantic letters to a married woman named Maria Cosway. In 1789, his letters grew less frequent. She continued to write to him and vented her frustration at his growing aloofness. After her husband died, Cosway moved to a village in Italy to open a convent school for girls. On Oct. 11, 1793, the death toll from a yellow fever epidemic in Philadelphia hits 100. By the time it ended, 5,000 people were dead. A vaccine prevents yellow fever in much of the world, though 20,000 people still die every year from the disease. On Oct. 14, 1944, German Gen. The Kanana Fou Elementary started its first Health Week celebration on Monday, Sept. 24 and say its been a great health and safety week for the first time this year, and according to the students they have captured its spirit wholeheartedly. I am good, I love to learn how to make the smoothie and I will tell my mom to give it to me after koogai on Sunday! Iosefa told Samoa News, one of the smoothie lovers of Level 4 yesterday. It is a change out of the ordinary classes assigned for each day of the week, and the sumba exercises early morning today, the kids were excited and very cooperative when they heard the loud music, said Renee, teacher of Level 4. Representatives of the WIC Program were asked to take time out and help out with the Safety & Health issues for the Level K5 & One, with WIC staffers teaching about the healthy diet foods, and how to stay clean when handling food or eating. The health basics was also their special topic and how to react to stress in times of natural disasters. The Tuesday schedule started with the ASCC Land Grant 4H Nutritions special class for level 2 & 3. They taught the Food Safety, Balanced Meals and especially, what to eat more of and which items of the food pyramid should you eat less. The session ended with a treat of healthy snacks. Wednesday was the repeat of the same lesson for the 4th & 5th graders, but the food preparation demonstrated how to make a Fruit Smoothie. That was also their treat of the day. Before the beginning of classes and after school Wednesday morning, the whole school came out to the basketball court for Sumba Exercises. That is a change, and all in Kanana Fou loved those two sessions, said Eine, teacher of Level 1. Thursday will be a repeat of the health classes for the 6th, 7th and 8th graders, where they will learn how to make pilikaki, eggs and vegetable paddies as healthy foods preparation and on Friday they are to learn all about disaster safety measures from Homeland Security Office personnel. Hurricane, Fire and Tsunami preparedness will be their focus on the last day of the Health & Safety week at Kanana Fou Elementary premises, and we are all eager to know them all, said Eline.

COMMERCE COMMISSION NOMINATIONS REJECTEd by ThE SENATE The Senate yesterday rejected all three nominations to the governments Commerce Commission, charged with overseeing public transportation, such as taxis and aiga buses. Local law states the commission is to consist of the Commerce Department director and four members appointed by the governor and confirmed by the Senate. Of the appointed members, one member each is from the Eastern, Western and Manua districts. The commission elects their own chairman at its first meeting each year. Gov. Togiola Tulafono recently nominated three members for each of the districts and they are Vaiausia E. Yandall, Faalae Tunupopo and Foinuu Folauoo. In his nomination letter to the Senate President, the governor said all of the men have lengthy records of service to their families, community and government. For example, Tunupopo and Vaiausia are former House members and have institutional experience with commerce transportation issues while Folauoo has experience in both public and private sector as an investigator. I believe that all three of these men have experience that will benefit and be an asset to the Commerce Commission, the governor wrote. Furthermore, all these men possess the requisite knowledge and understanding of the laws related to commercial carriers and the functions of the Commission in regulating and supervising commercial carriers and ensuring the safety of those who depend on public transpor-
tation in American Samoa, he said. The nominees appeared yesterday morning for a 30-minute confirmation hearing before a Senate committee followed by a final vote during the Senate session, but all three nominees failed to muster a majority support of the votes to be confirmed. Vaiausia and Tunupopo each received 7 yeas and 9 nays while Folauoo got 4 yeas and 12 nays. The governor has the option of reappointing the same individuals or submitting new names for Senate confirmation. The fourth appointed member to the commission is someone from the business sector. 2 GOVERNMENT lANd lEASES SENT TO FONO FOR APPROVAl Gov. Togiola Tulafono has submitted for Fono endorsement two leases of government properties. One lease is with Martin Anderson and his corporation for a piece of government property at Pago Park. The governor says this lease was executed by the parties and recorded in March 2004 and the tenants have occupied the land since that time. However, he said the current lease, which was originally for less than 10 years is set to expire on Dec. 29, 2012. The second lease is for Pritchard Airport Service for a warehouse, hangar and open space at the Pago Pago International Airport. The current lease, which expires Jan. 27, 2013, was duly executed in 2005. Earlier this year, both lessees informed the governors office of their wishes to exercise the options they were granted in the lease to extend

Ammonia leak on purse seiner closes shipyard for hours
On Tuesday morning, Sept. 25, the Shipyard Services Authority staff and employees were ordered by ASEPA and the US Coast Guard to evacuate their premises for four hours due to an ammonia leak that originated from a Tri Marine purse seiner, the Cape Breton, which was unloading fish at StarKist when the incident occurred. The ammonia leak did not affect StarKist, and cannery employees confirmed to Samoa News that they were not evacuated from their work place. However, the shipyard was evacuated because of its close proximity to where the vessel was unloading at the cannery. Samoa News understands that when the ammonia leak became apparent, the American Samoa Environmental Protection Agency, the Department of Homeland Security, the Fire Bureau and the US Coast Guard responded to the incident. Mike Wisneske, Tri Marine Fleet Manager told Samoa News the incident occurred Tuesday morning and where the leak exited has been repaired and the purse seiner is now at StarKist. Everything is back to normal as of today (Wednesday), he said. Witnesses told Samoa News that DHS employees were in HAZMAT suits, which are impermeable garments that cover the body as protection from hazardous materials, such as ammonia. Cape Bretons navigator, Justice Rodriguez told Samoa News that by Tuesday evening everything was back to normal the boat was aired out and returned to StarKist to continue offloading its fish. Chairman of the Shipyard Services Authority board, Carlos Sanchez told Samoa News they evacuated their facility from around 8 a.m to 12noon. He said he saw the tugboat moving the vessel to the middle of the bay, as the odor was very strong. He said a tugboat was used because the main engine of the vessel was not operational, and the tugboat had to position itself upwind as thats how strong the odor was, before it could tow the vessel out. Sanchez said they are looking at sending an invoice to Tri Marine, charging them for employee time loss.

WASHINGTON (AP) With college enrollment growing, student debt has stretched to a record number of U.S. households nearly 1 in 5 with the biggest burdens falling on the young and poor. The analysis by the Pew Research Center found that 22.4 million households, or 19 percent, had college debt in 2010. That is double the share in 1989, and up from 15 percent in 2007, just prior to the recession representing the biggest three-year increase in student debt in more than two decades. The increase was driven by higher tuition costs as well as rising college enrollment during the economic downturn. The biggest jumps occurred in households at the two extremes of the income distribution. More well-off families are digging deeper into their pockets to pay for costly private colleges, while lowerincome people in search of higher-wage jobs are enrolling in community colleges, public universities and other schools as a way to boost their resumes. Because of the sluggish economy, fewer college students than before are able to settle into full-time careers immediately upon graduation, contributing to a jump in debt among lowerincome households as the young adults take on part-time jobs or attend graduate school, according to Pew. As a share of household income, the debt burden was the greatest for the poorest 20 percent of households, or those making less than $21,044. In all, 40 percent of U.S. households headed by someone younger than age 35 owed college debt, the highest share of any age group. Comparing the debt to their economic resources, the lowest-income fifth of households are the ones experiencing the greatest stresses, said Richard Fry, a senior economist at Pew who analyzed the numbers. Noting that college enrollment has continued to climb since 2010, Fry added: Until college enrollment peaks, I would not expect the amount of outstanding student debt to level off. The study released Wednesday is based on the Survey of Consumer Finances, conducted every three years and sponsored by the Federal Reserve. The numbers are as of 2010, the latest available for that survey. Separate Fed data have pointed to subsequent increases in student loans since 2010 that totaled $914 billion in the April-June quarter, but dont provide demographic breakdowns on who shoulders the biggest burdens. Both President Barack Obama and his Republican challenger in this years election, Mitt Romney, have been seeking to court young voters with differing visions on how to address rising tuition and growing college debt. Obama wants to make tax credits for college expenses permanent and expand Pell grants for lower-earning families. Romney says that making government the direct source of federal student loans has not worked and simply drives tuition higher. He stresses the need to curb college costs. The Pew report found that the richest 20 percent of households, or those with annual income of $97,586 or higher, owed the biggest share of outstanding student debt 31 percent, up from 28 percent in 2007. The poorest 20 percent of households also saw their debt grow, to 13 percent from 11 percent. The richest households saw significant increases in perhousehold debt. For those with annual income of $97,586 to $146,791, college debt rose from $25,921 in 2007 to $31,989. For the richest 10 percent, making at least $146,792, college debt increased from $36,033 to $44,810. Across all households, the average outstanding college debt increased from $23,349 to $26,682. For the poorest 20 percent of households, the average debt rose from $19,018 to $20,640. In recent years, Americans have cut back on several other types of borrowing such as credit card use, with average household indebtedness falling from $105,297 in 2007 to $100,720 in 2010. Broken down by income levels, however, average total indebtedness for the bottom 20 percent of households by income actually rose from $17,579 in 2007 to $26,779; for the higher income groups, average indebtedness either was unchanged or declined. Samoas Prime Minister Tuilaepa Aiono Sailele Malielegaoi told the United Nations meeting on Rule of Law that since his country has no military forces, Samoas only guaranteed security is the strict observance of the rule of law, as well as Samoas cultural institutions and its chiefly system. He spoke before the United Nations General Assembly at U.N. headquarters in New York, Monday, Sept. 24, 2012. In his address PM Tuilaepa told the assembly the meeting is timely and its focus on the Rule of Law pertinent. Strengthening the Rule of Law at the national and international levels is key to guaranteeing peace and security, human rights, and social and economic justice for all. Telling the assembly that respect for the Rule of Law has been an integral part of Samoas journey as a proud independent nation for 50 years, he went on to highlight a few examples of how Samoa is contributing to its strengthening. SAMOAS CONTRIbuTIONS To increase our compliance with international law, we established a Law and Justice Sector which launched a four year plan with the vision of Justice for a Safe and Stable Samoa. The Sector Plan focuses on improving and strengthening the legal system and services in Samoa through increasing of community safety, improving access to justice, integrating customary and community based justice with the formal justice system and promoting integrity and good governance. A product of the Sector Plan was the establishment of the Samoa Law Reform Commission which is undertaking a comprehensive review of existing legislation and regulations to ensure that they reflect present day realities, congruent with the culture and traditions of a changing and modernizing Samoan society and in line with our international obligations. The Law Reform Commission works closely with relevant stakeholders and members of the public to assess legislative compliance of international conventions, particularly the human rights conventions Samoa is a state party to. PEACEKEEPING He told the international gathering that Samoa is fully committed to the peacekeeping work of the United Nations, one of the organizations most effective and successful mandates. The small size of our police force has not prevented us from contributing officers to peacekeeping operations in South Sudan, Timor Leste and to the Regional Assessment Mission in Solomon Islands. We are proud that more than 30% of our peacekeepers are women, already surpassing the UN goal. He also mentioned that Samoa is a participating country in the Justice Rapid Response multilateral stand-by facility. Being part of this initiative underscores Samoas strong support to ensure that all serious human rights and international law violations must be investigated and brought to justice. SAMOAS STRATEGy FOR dEVElOPMENT 2012-2016 The Prime Minister told the body, An improved quality life for all Samoans is the key underpinning of the Strategy for Development 2012-2016. A major goal of the strategy is strengthening social cohesion and stability and the need to have in place legislation to meet this ultimate goal. The Strategy contains concrete targets to support governments efforts to provide an enabling environment for private sector development, mindful of our responsibilities and obligations as a member of the World Trade Organization as of May this year. Women parliamentarians had always been an integral feature of all our Legislatives over our fifty year history. The amendment to our Constitution to be enacted before the end of this year to allow for 10% of the seats for women will ensure that there is a guaranteed minimum level of representation for them in our national Parliament. INTERNATIONAl CRIMINAl COuRT Samoa regards the International Criminal Court as an important part of the architecture of world peace based on the Rule of Law. The Institutionalization of the court ten years ago was a major achievement in the protection of human rights and in upholding international humanitarian standards. The unanimous approval last year of the Kampala amendments to the Rome Statute allows the crimes of aggression to be added, finally to the list of crimes that cannot go unpunished. In closing, he said Samoa is committed to ensuring that the Rule of Law is respected and adhered at all levels. I am happy therefore to announce that Samoa will be ratifying the Kampala amendments to the Rome Statute of the International Criminal Court on crimes of aggression tomorrow (Tuesday) as part of the UN Treaty Event. In a two-minute ad, Obama looks into the camera as he promotes an economic plan he says will create 1 million manufacturing jobs, cut oil imports and hire thousands of new teachers. New opinion polls, conducted after the video became public last week, show Obama opening up apparent leads over Romney in battleground states, including Ohio and Virginia. Romney told ABC News that the race was in a statistical tie in some national polls. Im very pleased with some polls, less so with other polls, but frankly at this early stage, polls go up, polls go down, he said. Obama was not about to let the video comments fade away. He said Wednesday that America is not about what can be done for us. Its about what can be done by us together, as one nation, as one people.

Such an attack would almost certainly lead to retaliatory Iranian missile strikes on Israeli population centers. Speaking to his Cabinet on Sunday, he said at the U.N. he would reiterate that the most dangerous country in the world must not be allowed to arm itself with the most dangerous weapon in the world. On Tuesday, the Maariv daily reported that Netanyahu would present his own red lines to the world body. It said Netanyahu would spell out what limits the international community should set for Iran to prevent it from becoming a nuclear power and how long that will take. Netanyahu has never laid out these limits precisely. Iran insists its nuclear program is for peaceful purposes but Israel, the U.S. and other Western allies reject the claim. Four rounds of U.N. sanctions have been placed on Iran. A U.N. report last month only reinforced Israeli fears, finding that Iran has moved more of its uranium enrichment activities into fortified bunkers deep underground where they are impervious to air attack. Enrichment is a key activity in building a bomb, though it has other uses as well, such as producing medical isotopes. While Israel is convinced that Iran is pursuing a nuclear weapon, American officials believe Iran has not yet made a final decision to take the plunge, even as it develops much of the infrastructure needed to do so. Obama has repeatedly said he will not allow Iran to gain nuclear weapons and has said the U.S. would be prepared to use force as a last resort. But in an interview Sunday with 60 Minutes he also vowed to block out any noise thats out there on the issue, in an apparent swipe at Netanyahu. Israels timeline for military action is shorter than that of the United States, which has far more powerful bunker-busting bombs at its disposal, and there is great suspicion in Israel over whether in the moment of truth Obama will follow through on his pledge. Netanyahu has a history of fiery speeches at the U.N. General Assembly. In 2009, he waved the blueprints for the Nazi death camp Aushwitz and invoked the memory of his own family members murdered by the Nazis while making his case against Irans Holocaust denial and threats to destroy Israel. To those who remained at the General Assembly while Iranian President Mahmoud Ahmadinejad spoke, he chastised: Have you no shame? Have you no decency?
Police chief resigns, NM force has gone to the dog

VAUGHN, N.M. (AP) The police chief of the small eastern New Mexico town of Vaughn resigned Wednesday, leaving the town with just one certified member on its police force a drug-sniffing dog named Nikka. Dave Romero, attorney for the town, said Wednesday that police Chief Ernest Chris Armijo decided to step down after news stories reported that he wasnt allowed to carry a gun because of his criminal background. He decided the attention was distracting, Romero said. State officials said Armijo couldnt carry a gun since acknowledging that he owed tens of thousands of dollars in delinquent child support payments in Texas. Armijo also faces new felony charges after being accused of selling a town-owned rifle and pocketing the cash. Romero said Armijo is working to clear up the latest case. He said Armijo has not ruled out seeking the police chiefs position again if his case is resolved and the position is open. According to records, the only qualified member of the Vaughn Police Department is Nikka, a drug-sniffing dog. Vaughns other officer isnt certified and pleaded guilty to charges of assault and battery last year. Noncertified officers cant make arrests and cant carry firearms. But Romero said not having an officer qualified to carry a gun didnt put Vaughn at risk. England doesnt allow police officers to carry guns, he said. Sometime the strongest weapon in law enforcement is communication. Vaughn, a town of about 450 located 104 miles east of Albuquerque, is a quiet town that is an overnight stop for railroad workers. And while residents say there is no crime problem, the town is set deep in what U.S. Homeland Security Investigations officials say is an isolated region of the state popular with drug traffickers. Officials say the desolate roads in Guadalupe County make it hard for authorities to catch smugglers moving drugs from Mexico. Guadalupe County Sheriff Michael Lucero said since news about the police chiefs record became public his department has helped patrol Vaughn. But he said those efforts have put a slight strain on his already short-staffed department. I visit the town at least once a month, said Lucero. The important thing is to keep a presence so residents know were there to help if were needed. Romero said town officials are considering whether to hire another police chief or keep the department staffed with just one officer. He said its unclear whether the town will keep the police dog, which had been in Armijos care. When approached by a reporter from The Associated Press at his Vaughn home, Armijo said he had no comment, and he declined to grant access to the canine for photographs or video. The dogs kennel could be seen in Armijos backyard, and a police truck marked K-9 was parked in his driveway. At Pennys Diner, residents said they were embarrassed by the attention the episode has put on the small town. Theres just a whole lot of nothing going on here, said cook Joyce Tabor. We have very little crime. Its quiet. So this really doesnt matter.

DETROIT (AP) Investigators will take soil samples from the ground beneath a suburban Detroit driveway after a man told police he believes he witnessed the burial of missing Teamsters leader Jimmy Hoffa about 35 years ago, police said Wednesday. Roseville Police Chief James Berlin said his department received a tip from a man who said he saw a body buried approximately 35 years ago and thinks it may have been Jimmy he saw interred. We are not claiming its Jimmy Hoffa, the timeline doesnt add up, Berlin said. Were investigating a body that may be at the location. Hoffa was last seen on July 30, 1975, outside a suburban Detroit restaurant where he was supposed to meet with a New Jersey Teamsters boss and a Detroit Mafia captain. His body has not been found despite a number of searches over the years. Innumerable theories about the demise of the union boss have surfaced over time. Among them: He was entombed in concrete at Giants Stadium in New Jersey, ground up and thrown in a Florida swamp or obliterated in a mob-owned fat-rendering plant. The search has continued under a backyard pool north of Detroit in 2003, under the floor of a Detroit home in 2004 and at a horse farm northwest of Detroit in 2006. After Roseville police received the most recent tip, the Michigan Department of Environmental Quality used ground penetrating radar on a 12-foot-by-12-foot patch beneath the driveway, said agency spokesman Brad Wurfel. It found that the earth had been disturbed at some point in time, Berlin said. The environmental quality department on Friday will take soil samples that will be sent to a forensic anthropologist at Michigan State University to have it tested for human decomposition, Berlin said. Results are not expected until next week. The FBI had no immediate comment on the new effort in Roseville. Andrew Arena, who recently retired as head of the FBI in Michigan, told Detroit TV station WDIV that all leads must be followed, but he would be surprised if Hoffa is buried there.

Every five years the US Economic Development Administration requires a major update of a communitys CEDS as a requirementf or EDA public works and technical assistanceg rants. ASG regards this as an opportunity to review its economic development policies, programs and priorities particularly under present unstable economic conditions. EDA has been a major force in American Samoas economic development for 40 years, having funded hotel, industrial park, port, and the market place and water and sewer utilities over that period. Hundreds of people representing the private sector, the executive office and the legislature have been consulted in the preparation of this CEDS. This consultation process will continue through the final completion and approval of the process. We want to make sure that there is an opportunity for the public to contribute to this process as well. For this reason, we are making a draft of the document available for public review and comment. John Garcia, owner of the Healing Hands Assisted Home Care facility where Claunch was living and where the confrontation with police happened, recalled a loving but also at times quarrelsome man. He was aggressive. As far as violent, I dont know, said Garcia, who was not there when the shooting happened. Every time (Claunch) got into a situation with me, I would just say, Brian, calm down, calm down, and I would walk away from him and in an hour or two he would be OK. According to court records, Claunch lost his left arm and leg because he firmly believed that the devil was in the left side of his body so he (decided) to lay down on the railroad tracks and waited for a train to come and (dismember) him. People with paranoid schizophrenia, a chronic condition, often see and hear things that arent there. Some of the worst aspects of Claunchs mental illness burst forth when he wouldnt calm down after demanding cigarettes and soda around 2 a.m. Saturday, Garcia said. A caretaker called police. Authorities say Claunch cornered a responding officer with his wheelchair and waved a shiny object in his hand. The other responding officer, fearing for his partners life and his own safety, shot Claunch in the head, police said. The shiny object turned out to be a ballpoint pen. Since the shooting, community and civil rights groups have called for changes in how officers are trained and disciplined. Houston Police Chief Charles McClelland has called the shooting tragic but asked people to reserve judgment until the departments investigation is completed. The FBI is monitoring the case. A mental status examination in 2002 found Claunch was pleasant and cooperative but had a history of psychiatric hospitalizations over the prior decade. He was unable to work and would not take his medications, leading to him hearing voices. A probate court judge declared Claunch a ward of the Harris County Guardianship Program in 2003.

Court records show Claunchs mother initially petitioned to be her sons guardian but changed her mind. Records show Claunch also had a brother and sister. Efforts this week to reach his family were unsuccessful. During the first two years of his guardianship, Claunch did well, living in a personal care home in Houston, according to annual reports submitted to the probate court. But by 2006, Claunch started running away, panhandling on local streets. Over the next few years, he went missing, was hospitalized and was in and out of jail on drug and trespassing charges. He also stopped taking his medications. In 2010, he was placed at a state mental hospital in East Texas for several months. He started living at Healing Hands in May 2011 but ran away after four months. He was found and brought back in March. At Healing Hands, located in a threebedroom home, Claunch lived with two other men. Estella Olguin, a spokeswoman for the Harris County Guardianship Program, said in the time Claunch was a ward of the county, he lived in at least 12 facilities. After coming back to Healing Hands, he seemed to do really well, she said. Garcia, 62, said he had twice before called police about Claunch both times because he left the home and refused to return. Claunch had seemed fine Friday night, said Garcia, who had given him a pack of cigarettes, two sodas and his medication before leaving around 8 p.m. But Claunch, a chain smoker, went through his cigarettes and soda and around 2 a.m. began aggressively demanding more of both from the overnight caretaker. The caretaker called 911, initially telling the operator he was having problems with a mentally ill person. Because of static on the line, its unclear if the operator knew about Claunchs mental condition, Garcia said. Citing the ongoing investigation, Houston police spokesman John Cannon said he could not comment on whether the responding officers knew of Claunchs mental state. Healing Hands does not have any signs outside saying it is a facility for mentally ill or physically challenged individuals. According to police, Claunch threatened to kill the two officers and tried to stab one with the shiny object in his hand. The officer who shot him, Matthew Marin, had fatally shot another suspect in 2009, firing on a man who was stabbing his neighbor to death and refused to drop the knife. A five-year veteran, Marin was placed on administrative leave after Claunchs death. Garcia said he is still in shock and is reserving judgment on whether the shooting was justified. I love Brian. Inappropriate behavior of DOE teachers

The defendant was represented by Barry Rose who did not wish to address the court. The prosecutor, Assistant Attorney General Kimberly Hyde, told the court the defendants inappropriate touching is absolutely unreasonable. The victims father took the stand and asked the court to sentence the defendant to the maximum allowable by the court, because he sexually violated his daughter. The father said the defendant is still teaching and is around children and they want that to stop. He said that the courts sentencing of the defendant sends a message to other predators that this is unacceptable. He added that most importantly after this case he hopes that the children will be able to come out and tell their parents when they are violated by their teachers or any person. He said this case should be an example to the other teachers or those who are thinking of doing these types of actions. Ward noted that there were a lot of statements from the community, noting the defendants long term service as a teacher. The judge asked the government and the defense counsel if they are aware of any protocols for teachers issued by the Department of Education regarding displays of affection as far as governing the behavior of teachers towards students; stated that the court was unable to find anything. We were likewise unable to find anything in DOE with respect to established procedures whereby students may come forward if they feel they have a legitimate complaint against a teacher. A hearing process that facilitates a student with a legitimate complaint as well as provides protection of a teacher from malicious accusations of a disgruntled student, a balanced procedure. What we saw in the presentence report here, although this is a private school, notwithstanding that private school is still under the authority of DOE and must follow the rules that DOE establishes, said Ward. He told the government that while this is a single case before the court, it may be time for the AGs office, given the increase in cases that are seen in this Territory, and for DOE to establish that hearing process and to mandate that process in private schools, so that every student has an opportunity to be heard. Again, with a system that is balanced, to minimize the effects of any malicious accusations that are unfounded. Its just time to establish those procedures, counsel, Ward said to Assistant AG Hyde. He added that the court was not able to find any are out there right now. Ive gone through restorative justice, therapeutic justice, all other kinds of models. I am finally getting down to the point that preventative justice, that if the court can through its authority at least strongly suggest that prevention measures be established out in the schools, in other areas of the community, then far more can be done than the inefficient system of this court, one case, one time going through. According to the governments case, the 13-year old victim, a student at Manumalo Baptist School, told police she had gone into the schools science lab when the defendant approached her and stated come here sweets. Its alleged the defendant asked the victim for the second time to come here and he allegedly pulled the victim closer to him and allegedly kissed her on the cheek. Victim told police that a similar incident happened with the defendant back in December 2011 before the Christmas break.

for first-degree murder in connection with the death of 23-year-old Wyatt Bowles Jr., in February 2003. He said changes to the death penalty law are appropriate, adding that another issue to be addressed under the current statute is the cost involved in defending/prosecuting capital cases. Risch-Fuatagavi said she strongly supports repealing the death penalty statute and noted that there are several reasons for this. Among them, she said the death penalty is not a deterrence tool and the death penalty is vengeance and not justice. She stated that the current statute is unconstitutional because it is cruel and unusual punishment. Another issue related to the U.S. Constitution, is that a jury is composed of a 12-member panel while in American Samoa, there are only six jurors to decide a capital case. Furthermore, its always difficult to find a fair and impartial jury on an isolated island with a small community such as American Samoa, Risch-Fuatagavi said, noting that notorious cases are highly published in the news media and on the internet and even before a trial, a jury is already influenced by the publicity. She also reminded lawmakers there is no method of carrying out the death penalty and there will be enormous costs to implementing such a penalty. She pointed out that if a lethal injection is used, you need to find a doctor
who is willing to carry out the injection. Risch-Fuatagavi again shared with lawmakers that it costs the defense between $6 and $10 million to properly defend a capital case, which goes through various appeal phases. She said this does not include costs for prosecuting such a case. (She first shared this information during the Fono joint budget hearings). Fepuleai said he supports the intent of the bill, and that he believes the changes are good. For the executive branch, he said enforcement of current laws can be done, but implementing this particular statute will be difficult and he echoed the testimony of the Public Defender dealing with the high costs involved. He also told the committee that he just received a copy of the bill Tuesday and there wasnt sufficient time to discuss it with others in his office for their reaction. He then referred to Jessop, who has been handling the governments criminal cases, including that of Siaumau Siaumau Jr., accused in the 2010 shooting of a police lieutenant. Jessop said capital cases are very difficult to prosecute and echoed statements by her boss and Risch-Fuatagavi of the high costs involved in such a case going to trial, and making sure that the constitutional rights of the accused are not infringed upon. Procedurally, she said, if such a person is found guilty during trial, then comes the sentencing phase, which is a different trial all together. It is very difficult she said, adding that prosecutor and the government will be faced with another problem, in that there is no method to carry out the death penalty if there is a guilty verdict. She said in jurisdictions where the death penalty exists, its costly to implement such a punishment. She also recalled that the last time a death penalty was carried out in the territory was in the 1930s and the punishment was hanging. And to quote the governor were a Christian nation. The committee is to decide soon on whether to move the bill to the floor for a vote.
