Proposal:
The applicant is proposing to operate a bed and breakfast facility, with four guestrooms, in his residence at this site. The historic property, listed on the National Register of Historic Places and a City designated landmark, includes generous space for common areasthat would be available for guests. On-site parking can accommodate up to six cars.In accordance with the regulations of City Code, Section 33.212.040 E, no commercial socialgatherings or meetings will be hosted. Private social gatherings of more than 8 persons wouldbe limited to no more than 12 events per year.

In order to provide for care and maintenance of the home for the proposed operation, up tothree nonresident employees would be hired. A lawn and landscaping maintenance company would also send about three employees to the site, on a weekly basis.In order to ensure that guests at the facility are respectful of the overall household and do notcreate any nuisance impacts for the surrounding residential area, the applicant has proposedto enforce the following “house rules:”
 
No illegal activities
 
No smoking on the property 
 
No pets
 
No eating in guestrooms
 
Guestrooms to be quiet after 9:00 pm
 
Use of audio music devices require approval of the owner or manager
 
No flood lights or laser lights used outside or inside
 
No extended idling of an automobile parked in front

If you disagree with the Bureau of Development Services administrative decision, you canappeal the decision to the Hearings Officer. This review body will hold a public hearing for theappeal. When the decision is mailed, the criteria used to make the decision and information onhow to file an appeal will be included. If you do not send any comments, you can still appealthe decision. There is a 14-day deadline to file an appeal beginning on the day the decision ismailed. The reason for the appeal must be specifically defined in order for the review body to

respond to the appeal. If an appeal is filed, you will be notified of the time and location of theappeal hearing. There is a fee charged for appeals. Recognized neighborhood associations may qualify for anappeal fee waiver.

After an appeal hearing, the review body decision may be appealed to the Oregon Land UseBoard of Appeals (LUBA) at 550 Capitol St. NE, Suite 235, Salem, OR 97301. The phonenumber for LUBA is 1-503-373-1265. Issues that may provide the basis for an appeal to LUBAmust be raised prior to the comment deadline or prior to the conclusion of the hearing if a localappeal is requested. If you do not raise an issue with enough specificity to give the Bureau of Development Services an opportunity to respond to it, that may also preclude an appeal toLUBA on that issue.
