Dear Mr. Ackerman: I write concerning Americans Elects recent entry into the Maine Senate race in direct support of Angus King, and to ask whether or not you support Americans Elects engaging in direct candidate support. You are listed as a member of Americans Elects board of directors. As such, you are responsible for Americans Elects actions, including for the accuracy of its filings with the Internal Revenue Service. Americans Elects IRS filings are crucial, because these filings are the sole source the public has with regard to learning about Americans Elects sources of support and activities. These filings are also important for Americans Elects contributors, as they set forth Americans Elects purpose. Notably, Americans Elects IRS filings state unequivocally that Americans Elect does not and will not support or oppose any candidate or candidate committee. Despite this, Americans Elect has recently spent over half a million dollars on television ads in Maine expressly advocating for the election of Angus King. As a member of Americans Elects board of directors, you have an obligation to explain to the public why Americans Elect has chosen to spend its publically undisclosed money in direct contradiction to its IRS statement of purpose; and to explain your role in its doing so. To that end, I respectfully ask you to answer the following questions: (1) Were you aware of, and did you support, Americans Elects intervention into the Maine Senate race? (2) Did the Americans Elect board of directors vote to approve this intervention into the Maine Senate race? (3) Did you, or are you aware of anyone else on the Americans Elect board of directors, have any contact with Angus King, the King campaign, or any agent of the King campaign, concerning Americans Elects intervention into the Maine Senate race?
