COMPLAINT UNDER SECTION 12 OF THE CONSUMER PROTECTION ACT 1986. It is respectfully submitted as under: 1.------basic information of party complainant. 2.------ basic information of opposite party. 3. That the complainant and opponent agree to transport mangoes from the Pune to Bombay on contractual basis through opponents vehicle. Copy of the contract is enclosed as Annexure A. 4. That the opponent was agreed to provide facilities for 4 (Four) month from 1st of June 2007, subject to monthly Rs../- consideration paid by the complainant. 5. That the opponent party provided facilities of transport for first one month (Month of June, 2007), and subsequently stopped providing transport facilities, from 1st of July 2007. 6. That a complaint sent two notices to opponent party for performance of obligation but opponent does not reply. 7. That because of assurance of the opponent party, the complainant made a contract with Mr. ABC, of supplying of mangoes on monthly basis. Copy of contract is enclosed as Annexure B. 8. The complainant could not fulfill his obligation, because of failure of the opponent to perform contractual obligation. 9. That the because of perishable nature of mango complaint suffered economical loss of Rs./-.

10. That the complainant has suffered great mental harassment from the opposite party for which the complainant claims damages as well amounting to Rs. /- along with other actual damage suffered 11. That cause of action arisen in the local limit of forum and valuation of complaint is Rs../-, thus the honble forum is having jurisdiction to entertain complain. 12. The complainant therefore prays: i. That the opposite parties may also be directed to pay damages amounting to Rs. ..towards mental agony and actual damages suffered by the complainant. ii. iii. Any other relief (s) which this forum may deem fit and proper under the circumstances of the case may be passed in favour of the complainant and against the opposite parties. The cost of complaint may be awarded.
