NondiscriminatoryProvisionWithinCity/CountyInterlocalAgreementSharonandTammy,ThankyouforspeakingwithusregardingtheCityofBocaRaton'sopt-outofPalmSeachCounty'sEqualEmploymentOrdinance("PSCOrdinance")andcertainrelatedissues.OurdiscussionalsofocusedonthestandardnondiscriminationclauseincludedintheCountyinterlocalagreementswiththeCity,suchasinthepending,proposedHazardousMaterialsEmergencyResponseServicesInterlocalCHazMatAgr").Aswediscussed,thisemailconfirmsourdiscussionandouragreement/understandingastothefollowingissues.GenerallyregardingthePBCOrdinance:ThePSCOrdinanceprovidesprotectiontoclassesofemployeesprotectedunderstateandfederallawplusadditionalcategoriesidentifiedbytheCounty.Cityemployeesreceivethebenefitofprotectionssetforthinstateandfederallaw.WhiletheCityiscommittedtoanequalemploymentworkplacepolicy,theCityhasnotelectedtoexpandthecategoriesofprotectedclassesbeyondthosespecifiedinstateandfederallaw.Pursuanttothe"opt-out"languageofthePBCOrdinance,theCityoptedoutandtheopt-outwasaffirmedinCityOrdinanceNo.5161(the"CityOrdinance").AcopyofthisCityOrdinanceisattachedforyourreference.TheCityOrdinancehadtheeffect,consistentwiththetermsofthePSCOrdinance,ofremovingtheCityofBocaRatonfromthejurisdictionofthePBCOrdinanceasanemployer,includingboththesubstantiveprovisionsandtheregUlatory/proceduralones.TheCityOrdinanceresultsinanopt-outfortheCityasanemployer,anddoesnotimpacttherights/obligationsofotheremployersandemployeeswithintheCitythatareotherwisecoveredbythePBCOrdinance.BasedontheCity'sopt-out,theCityandCountyagreethattheCountywouldnothavejurisdictionoveranemploymentdiscriminationclaimfiledbyaCityemployeeagainsttheCityunderthePBCOrdinance.GenerallyregardingtheinclusionofanEEOprovisionininterlocalagreementsbetweentheCityandtheCounty: ItistheCounty'spolicytoincludenondiscriminationprovisionsinitscontractsconsistentwithResolution92-13,asamendedbyResolutionR-2012-0197.Thenondiscriminationprovisiondoesnotprovideanythirdparties(e.g.,amemberofthepublicoraCounty/City employee)withanyrightsunderaninterlocal-
