OBJECTION BOARD MINUTES
September 17,2012(Not Yet Approved)
On September 17, 2012 the State Objections Board consisting
of
Secretary
of
State KrisKobach, Mark Dugan who sat
in
for Lieutenant Governor
Jeff
Colyer, and John Campbell whosat
in
for Attorney General Derek Schmidt met to convene as previously moved and to adjourn
sine die.
This case was originally heard at the September 13,2012 meeting which adjourned to adate certain so that more information could
be
gathered.Secretary Kobach opened the meeting by explainingth&t
staff
from his office hadsuccessfully obtained documents from the State
of
Hawaii; the State
of
Arizona, and a FederalDistrict Court in Mississippi in response to the directiot)
of
the Objection Board on September13,2012.Mr. Dugan moved that the documents obtained by the Secretary
of
State be admitted tothe official record, the objection
be
overruled and
the
meeting
be adjourned. Secretary Kobachasked that the motion
be
split into two motions:
onetoadmiithe
records, and one
to
adjourn themeeting. Mr. Dugan preferred
it
beonemotion,
and Mr. Campbell seconded Mr. Dugan'smotion.Ms. Orly Taitz interrupted the board
membersand
requested
to
speak.Secretary
Koba~kfirst
described
and~notedfrom
the documents received from the State
of
Hawaii and then addressed the motion that had been made by Mr. Dugan. Secretary Kobachexplained that the objectionto President Obama'scandidacy had been withdrawn at I :02 pm onSeptember
14,2012
by
the objector, Mr.
Joe
Montgomery. Since Mr. Montgomery withdrew hisobjection,the Objection Board was without jurisdiction to rule fllliher and had
no
objectionsbefore it at the time. Mr. Dugan questioned whether any official action needed to
be
taken
in
order to accept the rescinded objection,
and
Secretary Kobach explained that withdraws hadhistorically been taken without action by the Board.Secretary Kobach again asked Mr. Dugan to amend his motion since the Board no longerhad jurisdiction over the objection. Mr. Dugan did so and Mr. Campbell seconded.Secretary Kobach told Ms. Taitz that
if
she wanted
to
speak to the motion she would needto give her full name. Both Mr. Dugan and Mr. Campbell questioned the propriety
of
allowingMs. Taitz to speak.Ms. Taitz told the Board her name and that she was an attorney. Secretary Kobachexplained
to
her that the only people who had authority to speak were the
objector-
Mr.Montgomery and the
objectee-
President Obama. Ms. Taitz argued that Mr. Montgomery'sobjection was withdrawn under duress and that the Board had
in
its possession evidence
of
forgery. Secretary Kobach and Ms. Taitz disagreed over applicability ofK.S.A.
§
25-208A.
