Crique Sarco Village Resolution Date: 4th, October 2012. WHEREAS: ‘A. On June 28, 2010, the Supreme Court of Belize recognized the Maya customary land tenure that exists in the Toledo District and found that it constitutes “property” protected by the Constitution of Belize; B. The Supreme Court affirmed that the Maya Village of Crique Sarco holds collective, customary title to the lands and resources that we have traditionally used and occupied within our boundaries established through Maya customary practices; C. Our customary title is held by the Crique Sarco Village as a whole, and our customary ‘ownership includes the right of Crique Sarco Village to develop, control and peacefully enjoy those lands and all the resources located on them; . Our customary title also includes the individual derivative rights of Crique Sarco Village members to occupy or use the lands for farming, hunting, fishing, and the use of other resources for economic, cultural, and spiritual purposes; E. The Government of Belize has granted permission to US Capital Energy Ltd. to conduct exploratory drilling on our Maya Customary Lands, ineluding the Sarstoon Temash * National Park, which is @ part of our customary lands. F. Our community has not been consulted and has not granted our fee, prior and informed consent for such project. G. Our community has the right to fully and effectively participate in decision-making in matters which affect our rights, through representatives chosen by ourselves in accordance with our own procedures, as well as to maintain and develop our own indigenous decision- making institutions and representatives H. We have arrived at this resolution unanimously after having fully discussed this matter ‘within our village at a meeting of the community. ‘THEREFORE, We the villagers of Crique Sarco hereby: 1, Affirm our desire to safeguard our Supreme Court affirmed rights to our lands and resources that we use and occupy in accordance with our customs, 2. Oppose any attempt by the Government of Belize to deal in our village lands without the informed consent of our community as a whole, Crique Sarco Village Resolution, October 4th, 2012 13. Affirm our consent to have the Sarstoon Temash Institute for Indigenous Management (GATIIM) and its lawyers and experts to be our legal and technical representatives and ‘ake all necessary steps to protect and defend our collective, customary ttle to the lands and resources that we have traditionally used and occupied within our boundaries, established through Maya customary practices and reaffirmed by the Supreme Court of Belize 4. Affirm our intent to join with our neighboring villages to work collectively to preserve our affirmed rights over our lands 5. Authorize our Alcalde who is our village traditional leader and our village chairman, ‘long with the SATIIM, to take all necessary measures to safeguard and defend our collective, customary title to the lands and resources that we have traditionally used and ‘occupied within our boundaries established through Maye customary practices and ‘reaffirmed by the Supreme Court of Belize.
