NORTH YORKSHIRE COUNTY COUNCILEXECUTIVEDATE OF MEETING 6 NOVEMBER 2012REDEPLOYMENT OF RICHMOND LOWER SCHOOLReport of the Corporate Director - Strategic Resources
 
1.0 PURPOSE OF REPORT
1.1 To seek approval for the sale of the former Richmond Lower School, at undervalue.
2.0 ISSUES
 
2.1 Prior to 2011 Richmond Lower School was split over two sites, known as the
‘upper’ and ‘lower’.
As part of the Building Schools for the Future programme theschool was rebuilt entirely on the upper school site. The lower site became unusedwhen the school ceased using it in September 2011.2.2 The site has been occupied by Richmondshire District Council (RDC) since 6October 2011 by virtue of a Tenancy at Will.2.3 On 1st September 2011 the County Council awarded itself a general consentto dispose of the playing field area under paragraph 2 of the Schedule of theSchool Playing Fields General Disposal and Change of Use Consent (no3)2004.2.4 On 25 May 2012 NYCC were granted consent to dispose of the non-playing fieldarea (including buildings) under schedule 1 of the Academies Act 2010, whichreplaced schedule 35a.2.5 Agreement in principle to a freehold transfer (sale) of the whole site to RDC wasreached in September 2012. The area tinted red on plan number 4086 (appendix A) shows the extent of the proposed transfer.2.6 RDC will use the newer buildings (edged blue) as offices, which will enable thesale of several smaller RDC owned buildings elsewhere in Richmond, thusconsolidating the Council onto one site. The older buildings (edged green) will bemade available by RDC for community use.2.7 Because RDC lack sufficient funds to pay market value and due to the high cost of 
refurbishing the building, a sale at below market value is proposed. NYCC’s
financial position will be protected as set out in paragraph 3.3. The LocalGovernment Act 1972 General Disposal Consent (England) 2003 gives NYCC thepower to dispose at undervalue in these circumstances.

3.0 FINANCIAL IMPLICATIONS
 
3.1 The market value of the whole site for the proposed use by RDC is £675,000(Valuation provided by Bruton Knowles, July 2012)3.2 The proposed consideration for the transfer is £400,000 which represents anunder value of £275,000. This represents a market value for the part of the sitethat RDC intends to use itself. The intention is that the balance of the site will beused by the community.3.3 The transfer will be subject to restrictive covenants which will ensure that NYCCreceives further payment should the site be developed or sold for profit by RDCor successor organisations in the future.3.4 The running and security costs of the building are at present being met by NYCC.Since closure this amounts to £8,350 or almost £ 700 per month. As well asgenerating a capital receipt, selling the building will free NYCC from thisexpenditure.3.5 To support the community use of the site it is proposed that a grant of £20000 isoffered to the community group that takes over the Victorian part of the buildingas a contribution towards refurbishment works.
4.0 REASON FOR RECOMMENDATION
 
4.1 The site is not required for re use by NYCC, and the costs of repair and/or refurbishment would in any event be prohibitive if it were. It is recognised that anopen market sale may result in increased capital receipt, but given that RDC haveexpressed interest in the site for some considerable time, and in the spirit of partnership working, it is appropriate to proceed with a sale to that authority.
5.0 RECOMMENDATION
5.1 That the Richmond Lower School site be transferred to RichmondshireDistrict Council for a consideration of £400,000 and upon other terms to be agreedby the Corporate Director, Strategic Resources.Gary FieldingCorporate Director
