This entire matter is expensive with 31 services and copying considered. I am going to need about $700 when the OSC is signed for overnight mailed of what is now about 200 pages x 31. So far Mr. Trump has not given even one penny, why? who knows? Donald dances to his own children's drum beat as they want to be invited to all the parties BHO throws I guess?

Today 11-30-12 my second affidavit in support of an OSC was duly served and submitted to the Hon. David I. Schmidt JSC at IAS Part 1 and Hon Arthur M. Schack JSC at IAS Part 23 for their review requesting a expedited trial of the facts of forgery. I will submit a Note of Issue 12-5-12.

It is NOT possible to amend a Petition there must be an additional Petition that when approved for filing by Justice Schack will then be consolidated with 21948-2012 and as such awaits my action. Filing fee $350 with OSC to Schack by end of week.

I about to write another Petition of the NYS BOE and Governor as to the US Senate Election as each have a role that Justice Schmidt considers necessary. And as for the Involvement of the NY SOS, Gov. Assembly Speaker, NYS AG and Controller as Electoral College electors must be added also as they are affected by the decision that would come from 21948-2012 and must be afforded due process .

I just received a call from the Law Clerk to Justice Schmidt. He declined to sign as in his opinion The Governor and NYS BOE are necessary parties to the Petition herein; and as such I have to petition Justice Schack for permission to include those as Respondents. I am beginning such a petition now.

The, NYSAG and I appeared before the Honorable David I. Schmidt JSC at Part 1 for elections. We argued both sides of res adjudicata and collateral estoppel. I argued that there is no identity of either Parties or issues and that this case stems from the 2008 Article 78 decision as a matter of "incompatibility" of electors to serve.. Justice Schmidt took the OSC application would get back by Weds

I have paid for the OSC FEE with the Clerk of the Court and am waiting for a conference with the clerk supervisor in regards to the NYS AG letter of 11-16-12 as to the prior order regarding my ability to file a new case. All the parties in the captioned case are new and issues are not of identity; and therefore there is no good reason why my case should not go forward other than pure poltics
