 Notice to the Persons Whose Legal Rights, Duties or Privileges Are at Issue 
On October 3, 2012, the Department of Environmental Protection (“Department”)accepted as complete for processing an application for amendment of DepartmentOrder #S-20700-WD-N-A, a solid waste disposal license for Juniper Ridge Landfill.The application is for an amendment of the license for the Juniper Ridge Landfilllocated in Old Town, Maine to accept municipal solid waste from sources within theState of Maine as a result of the anticipated closure of the Maine Energy facility inBiddeford. The Juniper Ridge Landfill is owned by the State of Maine and operatedby NEWSME Landfill Operations, LLC. The relevant statutory and regulatory criteriafor the requested license amendment are: Maine’s Waste Management Act, 38M.R.S. §§ 1301 through 1310-BB and the Department’s Solid Waste ManagementRules, 06-096 CMR Chapters 400 through 419. By letter dated October 24, 2012, theCommissioner exercised her discretion pursuant to 06-096 CMR Chapter 2, Section7.B to hold a public hearing on the application. Heather Parent was delegated by theCommissioner to be Hearing Officer for purposes of carrying out the public hearing onthe matter. Notice of the hearing date, time and location will be published at a later datein accordance with the requirements of the Maine Administrative Procedure Act andDepartment regulation. At this time, any person desiring to participate as a party to the proceeding must filea written petition for leave to intervene. The petition for leave to intervene must showthat the petitioner is a person who is or may be substantially and directly affected by theproposed license amendment or that the petitioner is any other agency of federal, stateor local government. Intervenors should have reasonably specific contentions regardingthe subject matter of the hearing and be prepared and capable of participation in thehearing in order to support such contentions. Persons granted intervenor status will have the right to offer testimony and evidence,participate in cross-examination of other parties, and will have the responsibility toattend pre-hearing conferences and abide by all procedural orders. Intervenors willlikely be required to file all testimony prior to the hearing for review by the Department,the applicant, and other intervenors in advance of the hearing in preparation for cross-examination.Members of the public who wish to provide comments to the Department about theapplication do not need to petition to intervene.
