Ten weeks ago ( June 26"), We as a council were told that the baseball “deal” had a short window of opportunity for this community and thus we had to act on this opportunity or loose the opportunity and thus we could not place the item on the quality of life bond election coming up on Nov 6th, This community is 7 weeks away from voting on a quality of life bond that includes an entertainment venue. Why the rush and why have we not heard whether the team will or will not be acquired by the Mountain Star Group? 1119-021 2. A fixed fee surcharge of 10 cents on each ticket for the next 25 years, why the low amount? Ten cents is worth very little in today’s’ dollars, in 20 years it will be worth much less. If this baseball stadium is the economic stimulus needed that will create jobs in El Paso then are we assuming that in the next 10, 15, 20, 25 years we will continue to have the low per capita income? 3. Why cap the revenue to the city at $75,000 on the 10 cent fee? And why is the fee constant for the 25 year lease commitment? Same issue with the per capita income. 4. A very low lease payment from the team owners as it appears lower than any other PCL contract ( ball players get paid by the parent company, in this case the San Diego Padres. This includes team uniforms, bats, balls, caps, etc.) Same issue with the per capita income. 5, Why is 78% of the lease payment being placed in a fund for future improvements to the baseball stadium. ! have reviewed other lease contracts with other cities and non-have this stipulation. Perhaps you can find cities where 75% of the lease payment is reserved for improvements. Why such a high amount when the baseball stadium will be new? 6, 100 % Revenue from concessions and advertisement at the ballpark designated for the team owners, why with such a low lease payment why Is the city not to share in this revenue? 7. 100% of the revenue for naming rights designated for the team owners when other cities such as. Oklahoma the naming rights revenue proceeds are received by the city and not the team owners? 8. The city will receive no more than $30,000 from parking fees in any caléndar year, why? 9. A non-compete clause which | am unable to find in any of the cities that have triple A team contracts that | have reviewed, why have the owners insisted on this clause? The team owners have indicated they will donate the profits from the baseball venture to nonprofit corporations, a very honorable gesture, however, when is the breakeven point of the lease? 5yrs, 10 yrs.? In essence when do they recapture their investment and what year would they expect to be earning profits? What is the magnitude of those profits? Rather than donating any potential profits why not use those profits to pay off the city issued debt? 13. What other cities have invested in a triple A stadium and have not had the economic impact that was expected? What was the per capita income of those cities? What other uses for the stadium been incorporated so that the investment is not a total loss? | am still reviewing the contracts for the following cities, Tacoma, Reno, Salt Lake, Round Rock, Oklahoma City and may have additional questions which | will send you via email. Pethaps you could suggest other cities’ contracts that | may review that may include some of the same provisions as found in the proposed El Paso lease. An article in the Aug. 4 El Paso Times compelled me to respond on behalf of my colleagues, the former mayors of the 1980s and 90s, who were accused of doing nothing to improve our city’s infrastructure during that period. This attack is as old as politics itself and is coming out of Washington today: The last guy left me with this mess. We El Pasoans are frustrated and we want a solution. All of us want El Paso to be better. We now have a bond issue before us to try to fix some of our problems. Many of the issues deserve our serious consideration, and I recommend that El Pasoans look at each issue wholeheartedly to determine their support. This column concerns only one issue: the baseball stadium, which in my opinion is an absolutely disastrous idea that will lead to both a financial and a structural Armageddon to the detriment of our city for decades to come. Here is our record regarding the infrastructure improvements during the 1980s and 90s. These are just some of the major initiatives under our five administrations: + New zoo * Cohen Stadium * New airport and air cargo facility « New art museum « Major expansion of civic center * New Union Plaza entertainment district * Resurfacing all city streets, under Jonathan Rogers New police headquarters « New fire headquarters with maintenance facility « New state of the art communication system «* First-ever main frame data processing system * Construction of several recreation and senior centers * Repair of most existing swimming and recreation centers * Construction of the first section of Loop 375 * Widening and landscaping of a major potion of Alameda and North Loop Construction of a new recreation center at Fort Bliss to show appreciation for our soldiers * Painted Dunes golf course This is representative of the capital investment the five administrations put into our city. In comparing this effort in both dollars and projects, it would appear that we did our part. As a side note, we were lobbied by the private sector to expand the civic center to bring in larger conventions and to build Union plaza to provide a venue for new restaurants and entertainment. A one can see, the problem with revitalizing Downtown is difficult and the taxpayer cannot be the major investor with little more than promises from the private sector. The baseball stadium is being proposed as the cornerstone of a new revitalization for El Paso’s Downtown; however, the economic and structural drain on city government and ultimately the taxpayers is horrendous. The list of problems with this deal is massive and well- documented in the past two weeks by our citizens. The investment percentages by the city versus the team owners are lopsided and unfair, to start. There is zero return or repayment by the team owners. Albuquerque, N.M., gets about $700,000 rent per year and a percentage of all concessions. We get $50,000 per year - not the $200,000 advertised. We are giving them the stadium and parking garage for free. The most troubling aspects of this are the scattering of city government around town, the secrecy of negotiations, the lack of disclosure to our citizens of the cost and impact, and an apparent deliberate attempt to conceal the whole process from our citizens. We can no longer trust city government. Since this will not work, we will be faced with building a new city hall at some time in the near future. Paul Foster, possibly unwittingly, summarized our problem in a recent interview. It will take a repopulation of Downtown by business and government, filling our buildings and drawing private investments in order to rebuild Downtown. He had admitted that the employees of his own company “did not like living in El Paso,” so the company moved to Phoenix. If we cannot keep his company, who can we get to come to Downtown? Again, we all want what is best for our city. We want our younger generation to have a reason to stay home, and have jobs and to have positive experiences. For the most part, our problem has been coming on for years through no fault of either elected officials or the private sector. We are depending on our business, civic and government leaders to find solutions.
