Defendant’s Interpretation of (i) Magistrate’s 12 December 2008 instructions:
Concern for expeditious court proceedings in this matter, to avoid wasting thecourt’s time with issues that could be resolved professionally and expeditiouslyout of court

(ii) Honourable Legal Psychological Integrity Conduct Principles:
“A lawyer shall not suppress any evidence that he or his client has a legal obligation toreveal or produce.”“A public prosecutor or other government lawyer in criminal litigation shall make timelydisclosure to counsel for the defendant, or to the defendant if he has no counsel, of theexistence of evidence, known to the prosecutor or other government lawyer, that tends tonegate the guilt of the accused, mitigate the degree of the offense, or reduce thepunishment.”

The Further Particulars of 12 December 2008 are Incomplete, as follows:
1.
No New Evidence : The Further Particulars of 12 December 2008 contain NoNew Evidence to this Crimen Inuria Case, dismissed from the Court Role byMagistrate Tyulu on 02 June 2008 (Dismissed when SAPS failed – due to a‘backlog’ – to produce the alleged Outsanding Warrants etc.).
On 02 June 2008, Magistrate Tyulu struck this crimen inuria matter from the Magistrate’s Court’sroll, due to the SAPS incomplete investigation, to provide required documentation to theFurther Particulars of 22 August 2007.The Further Particulars of 22 August 2007 were incomplete, the following documentation beingeither intentionally or negligently and irregularly withheld from the Defendant, and herCounsel, by the SAPS and/or NPA: (1) Two alleged outstanding Warrants, used by SAP InspectorChristian, to arrest and detain Defendant in this Crimen Inuria matter, on 18 July 2007; (ii)Outstanding Due Process documentation of 19 July 2007 Referral for State Psychological Report;(iii) Outstanding Prior Relevant Legal Correspondence between Plaintiff and Defendant.Accordingly, the Further Particulars of 12 December 2008 contain No New Evidence, noraforementioned Required Evidence; to this Crimen Inuria Matter struck from the Role byMagistrate Tyulu on 02 June 2008. Accordingly the Further Particulars of 12 December 2008, likethe Further Particulars of 22 August 2007, are incomplete.

Outstanding Evidentiary Documentation: ‘Outstanding Warrants’ : Two Alleged‘Outstanding Warrants’, used by SAP INSP. Christian, to plausibly irregularlyor illegally arrest and detain Defendant in this Crimin Inuria Matter, on 18July 2007.
At the time of Inspector Christian’s arrest of Defendant, Inspector Christian stated hisjustification for the Arrest were two outstanding Warrants, one allegedly in Pietermaritzburgand one in Port Elizabeth.Defendant requested proof and copies of these alleged Outstanding Warrants, as per theConstitutional Principle “to be informed of the charge with sufficient detail to answer it.”Inspector Christian refused to provide proof of these alleged outstanding warrants, andproceeded to arrest and detain Defendant.The proof of these alleged Outstanding Warrants used to arrest and detain Defendant on 18 July2007, have yet to be provided by Inspector Christian, the South African Police Services, or theNational Prosecuting Authority; and were requested from the SAPS and the National ProsecutingAuthority, by Lara Johnstone; from Attorney Mr. Malcolm Gezzler, by Lara and Andre Johnstone,
