STATE OF WISCONSIN CITY OF FRANKLIN MILWAUKEE COUNTYORDINANCE NO. 2009-_____ AN ORDINANCE TO CREATE CHAPTER 191 OF THE MUNICIPAL CODERELATING TO THE NON-REGULATION OF EMPLOYEE WAGES OR BENEFITS FOR PRIVATE BUSINESSES _____________________________________________________________________ WHEREAS, the Common Council of the City of Franklin seeks to foster a positive and growing business climate within the City; andWHEREAS, Franklin is home to many small and medium sized businesses;andWHEREAS, the Common Council of the City of Franklin recognizes itsresponsibility in promoting a free market and limited government intrusion into private enterprise. NOW, THEREFORE, the Mayor and Common Council of the City of Franklin, Wisconsin do ordain as follows:SECTION 1: Chapter 191 of the Municipal Code of the City of Franklin,Wisconsin, is hereby created to read as follows:“Chapter 191 PRIVATE BUSINESS EMPLOYEE WAGE ANDBENEFIT NON-REGULATION§191-1. Limitation of municipal regulation. No ordinance of the City of Franklin nor any other municipalordinance, rule, or regulation shall mandate that any businessentity, other than the City itself, shall provide certain wages or benefits to its employees or set forth the amount or type of anyemployee wages or benefits provided by an employer locatedwithin the City limits.”SECTION 2: The terms and provisions of this ordinance are severable.Should any term or provision of this ordinance be found to beinvalid by a court of competent jurisdiction, the remaining termsand provisions shall remain in full force and effect.SECTION 3:All ordinances and parts of ordinances in contravention to thisordinance are hereby repealed.
